Substitute

Revises recitals; increases membership on the Public Service Grant Council by 2 (an additional appointee each for the Mayor and City Council); provides for establishment of Priority Populations on or before January 15, 2008 (rather than March 1, 2008); provides that no public service grant shall be awarded to a recipient who has been in operation less than 3 years, except upon recommendation by the Public Service Grant Council; requires that a requesting agency submit its appropriation request to the Public Service Grant Council no later than March 15th each year (rather than July 31 each year);

Per Office of General Counsel, amendment adopts a revised legal description dated September 13, 2007 (Revised Exhibit 1), a revised PUD Written Description dated September 13, 2007 (Revised Exhibit 2) and further subjects the PUD to the following conditions:  development shall be subject to Traffic Engineering Division Memo dated August 21, 2007, or as otherwise approved by Traffic Engineering Division and the Planning and Development Department; three-foot-high evergreen hedges shall be maintained around the periphery of each parking lot in addition to the landscaping and buffering already provided for in the Written Description; boat trailers shall not be parked in any lot;  and there shall be no lighting installed in any of the parking lot areas, provided, however, that this condition is subject to modification, review, and approval by the Planning and Development Department (planned to have lighting below four feet for safety and security purposes).

Includes recitals and clarifies intent concerning nonconforming uses; revises definition of “dancing entertainment establishment;” revises the permitted or permissible uses in various zoning districts relative to dancing entertainment establishments; requires a zoning exception any time 1 or more principle uses allowed by right is combined with a use regulated under alcoholic beverages provisions of the Zoning Code; includes the terms “dancing entertainment establishment” and “principle use” among other definitions in the Zoning Code.

Per Office of General Counsel, amendment adopts a revised PUD Written Description dated August 15, 2007 (Revised Exhibit 3), and further subjects the PUD to the following conditions:  development is subject to the Traffic Engineering Division Memo dated October 2, 2007, the FDOT Memo dated October 10, 2007, or as otherwise approved by the Traffic Engineering Division and the Planning and Development Department; along the Beaver Street road frontage, the developer shall provide landscaping, including grass and trees every 25 feet (minimum 2-inch caliper), and shrubs and hedges; lighting fixtures shall be flush mounted with full cutoff screens and a lighting plan showing a grid of foot-candle illumination levels at regular fifty foot intervals shall be subject to the review and approval of the Planning and Development Department at the time of verification of substantial compliance;  and the storm water or other ponds shall be constructed with 45 degree angles to minimize use by wading birds.
