Provides for the site plan and written description of August 30, 2007; includes recommended PUD conditions (development to proceed in accordance with memoranda; developer to provide an 8-foot tall, 95% opaque, fence along the west property line, from the north property line to the south property line; said fence is to be constructed of a man-made composite material).

States that the final assessment may be paid in its entirety within 30 days after being added to the lien improvement book (replacing language specifying at any time by October 15, 2007, without accrual of interest); replaces provision concerning notice to benefited property owners to require that notice of this ordinance and assessment be provided to benefited property owners by the Tax Collector in a manner consistent with all applicable City ordinances and state laws.

Provides for a Revised Exhibit 3 and a Revised Exhibit 4, which are the Second Revised Schedules C and D to reflect that they are amended schedules to the Fiscal Year 2006-2007 City Budget; replaces reference to “Amended Schedules” with reference to “Second Revised Schedules.”

(TEU) Provides for a Second Revised Exhibit 2, which corrects the License Agreement for crossing class designations.

 

 

 

 

 

(F) Provides for a Revised Exhibit 2 and a Revised Exhibit 3, which corrects the License Agreement for crossing class designations and the License Fee Reimbursement Agreement for Kimco to pay 50% of the annual maintenance costs for both crossings, respectively.

Provides for the site plan of August 27, 2007, and the written description of September 5, 2007; includes recommended PUD condition (PUD not to become effective until the City receives written notice of recordation of conservation easement covering the conservation area acreage depicted on the site plan, within 60 calendar days of ordinance approval; said recorded conservation easement is to be in a form acceptable to the Office of General Counsel; if the easement is not recorded within 60 calendar days, the PUD is deemed not effective and the zoning designation of the subject property shall remain CRO).
