Amendment

(Finance) Provides for a Revised Exhibit 2 (Third Amendment to Redevelopment Agreement), dated 12-01-08, clarifying the improvements are to the road and not the interchange, deleting the scope of performance from the technical changes, clarifying 1 car dealership, and requiring annual reporting, no extensions, and termination by Council for failure to make progress; removes “scope of performance” from definition of “technical” in the body of the bill.

Per the Office of General Counsel, the Amendment corrects the acreage in the body of the bill (7.23 as opposed to 7.04).  The original legal description and maps correctly describe and show 7.23 acres so no changes to the attached Exhibits are required.

Per the Office of General Counsel, the Amendment corrects the acreage in the body of the bill (7.23 as opposed to 7.04), incorporates a Written Description dated October 16, 2008, and a Site Plan dated September 8, 2008, and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated October 15, 2008, or as otherwise approved by the Planning and Development Department;  the development shall comply with Section 656.398 regarding architectural guidelines for the Mayport Village and Section 656.399 regarding lighting and utility lines;  and JaxPort shall provide public access to the waterfront along at least 500 feet in the center portion of the subject property while a ship is not in port and JaxPort shall have sufficient time after departure and prior to return to open and close the public access for safety purposes.

Per the Office of General Counsel, the Amendment GRANTS the Waiver of Road Frontage off of Sandler Road in District 12 subject to the following condition:  the owner shall post the subject property’s address at the terminus of the public portion of the Sandler Road right-of-way for notification to emergency responders.

Per the Office of General Counsel, the Amendment GRANTS the Waiver of Road Frontage at 14541 Philips Highway in District 13 subject to the following conditions:  the waiver shall be personal to the property owner and non-transferable pursuant to Section 656.407 of the Zoning Code;  both dwellings shall be addressed at the subject property’s vehicular access point (which is the current entrance with the mailboxes); and the subject property shall retain its current configuration and shall not be subdivided.

Per the Office of General Counsel, the Amendment GRANTS the Sign Waiver on Lenox Avenue in District 12 subject to the following conditions:    no scrolling or fade-in messages are permitted; and the electronic message display shall be static (cycle no more than once every 3 minutes) and shall contain amber lighting (as opposed to red lighting).
