Substitute

Per the Office of General Counsel, the substitute changes the rezoning application from a request to CCG-1 to a request to PUD for commercial and office uses.  The new PUD application will be renoticed and readvertised for public hearings.

Amendment

Per the Office of General Counsel, the Amendment incorporates a revised PUD Site Plan dated September 10, 2008 and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated September 8, 2008, and the Florida Department of Transportation memorandum dated July 15, 2008, or as otherwise approved by the Planning and Development Department and the FDOT; at the time of verification of substantial compliance with the PUD, a master site plan including landscaping, parking, and pedestrian circulation  shall be submitted to the Planning and Development Department for review and approval and this condition shall not be interpreted as requiring a PUD to PUD rezoning, and submittal of the master site plan shall otherwise conform to Section 656.341(F)(1);  the building architecture shall be subject to the review and approval by the Planning and Development Department and shall follow design principles in the Commercial Design Guidelines and Best Practices Manual;  internally-illuminated wall signs may only face Atlantic Boulevard;  the outdoor sale and service of goods shall be permitted, except for on the west and south side of Parcel A;  two drive-through restaurants shall be permitted on Parcel B and Parcel C; however, 24-hour drive-throughs are specifically prohibited;  the development shall not use the Floridan aquifer for irrigation and shall use reuse water when available.

Per the Office of General Counsel, the Amendment grants the Waiver of Road Frontage Application, thus reducing the required road frontage for property at 11670 Mandarin Road from 80 feet to 0 feet, subject to the following conditions:  the address shall be clearly marked and identified on Mandarin Road; and the easement to the property shall be improved to provide a stable travel surface and positive drainage, subject to the review and approval by the Department of Public Works.

Amendment

Amendment      Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  tree removal and landscaping shall be subject to Part 12 of the Zoning Code and the review and approval of the Planning and Development Department; and the developer shall submit a revised parking plan to the Planning and Development Department for review and approval.  The revised parking plan shall provide between eight and twenty-five additional non-handicapped parking spaces to the existing 134 non-handicapped parking spaces and six handicapped parking spaces.  The final number and location of the additional non-handicapped parking spaces shall be subject to review and approval by the Planning and Development Department.  The Department shall determine the number and location of the additional non-handicapped parking spaces according to, but not limited to, the following criteria:  trees, 18 DBH or greater, shall be preserved to the greatest extent possible while maximizing the number of additional parking spaces to meet demonstrated additional parking needs for the expanded marina use within the yacht club.

Per the Office of General Counsel, the Amendment incorporates a revised legal description dated September 11, 2008 to add a missing Real Estate Number and adds the following condition to the PUD:  the developer shall preserve trees when possible and at verification of substantial compliance with the PUD, the developer shall submit a tree survey showing all trees larger than 5 inches DBH, and removal of any such tree shall be subject to the review and approval by the Planning and Development Department.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:   development shall be subject to the Development Services Division transportation memorandum dated July 30, 2008, or as otherwise approved by the Planning and Development Department;  the silviculture operation shall be subject to the applicant providing documentation that the operation has been maintained on the property within the past 20 years, subject to the review and approval by the Office of General Counsel and the Planning and Development Department, and all tree credits are subject to the review and approval by the Planning and Development Department;  and the development shall not use the Floridan aquifer for irrigation.
