Amendment

Provides that all employees seeking to revert from the DB plan to the DC plan must be certified to have completed the intensive training program sponsored by the City.

Incorporates a revised Written Description dated July 7, 2008, and a revised Site Plan dated July 23, 2008; includes recommended PUD conditions (development shall proceed in accordance with the Development Services Division transportation memorandum dated June 23, 2008, or as otherwise approved by the Planning and Development Department; ground-mounted or monument-style signage shall be externally illuminated only; prior to verification of substantial compliance of the PUD, the developer shall submit architectural elevations of the townhome and condominium buildings for the review and approval of the Planning and Development Department).

Per the Office of General Counsel, the Amendment incorporates a revised PUD Site Plan dated August 14, 2008, and adds the following conditions to the PUD:  the development shall be subject to the Development Services transportation memorandum dated June 24, 2008, or as otherwise approved by the Planning and Development Department;  signage shall be limited to wall signage and to no larger than four square feet in area;  all requirements of Section 656.1216 of the Zoning Code shall be met, however, the fence height may remain at six feet;  access shall be limited to one driveway on Fair Street located within 40 feet of the southern property line;  an evergreen hedge shall be provided in front of the existing six-foot fence to screen the vehicular use area from the Fair Street right-of-way;  and no trees shall be required as part of the buffer between uncomplementary uses.

Per the Office of General Counsel, the Amendment grants the sign waiver at 3707 Hendricks Avenue in District 5, which reduces the required setback for the sign from ten feet to five feet.

Per the Office of General Counsel, the Amendment DENIES the Appeal and upholds the Final Order of the Planning Commission granting a Minor Modification to the Planned Unit Development at 13114 Atlantic Boulevard in District 3.  The Minor Modification combines two parcels within the PUD for permitted multi-family development and requires thirty parking spaces for marina uses (in addition to eighteen parking spaces in other areas of the PUD).

Per the Office of General Counsel, the Amendment revises the proposed Settlement Agreement with the Department of Community Affairs to state that the Land Use Classification for property on Starratt Road will be changed BACK to LDR (as opposed to RPI, as requested) in order to settle the pending case before the Division of Administrative Hearings.

Per the Office of General Counsel, the Amendment attaches the proposed Settlement Agreement with the Department of Community Affairs regarding the text amendment to the Comprehensive Plan related to School Concurrency.  Per the Settlement Agreement, the case before the Division of Administrative Hearings will be settled as long as the City submits a revised Interlocal Agreement regarding School Concurrency correcting one sentence related to DRIs, which was inconsistent with the language mandated by State law.

Corrects a scrivener’s error in the chapter number (Chapter 655 rather than 150); provides that if a request for an extension is approved, the Concurrency Management System Office (CMSO) shall then forward the fair share assessment contract extension to the Office of General Counsel and the Council Auditor’s Office for review and approval, with notice thereof to the District Council Member and members of the committee of reference, prior to execution by the director; in the event a fair share assessment contract is extended, requires payment of 5% of the total assessment “including the annual inflation adjustment” to the CMSO on each anniversary date of such extension.

Corrects the citing of a section heading in the title; includes amendment of Section 655.305 to clarify that the correction of errors in calculation includes, but is not limited to, mathematical errors, errors in the identification of deficient road links, or other technical errors; provides, upon request, for withdrawal of a fair share contract in the case of an error; provides for reapplication for a new fair share contract under the circumstances existing at the time of payment of the initial $500 application fee within 6 months of such withdrawal by Council.
