Amendment

Per the Office of General Counsel, the Amendment incorporates a revised PUD Site Plan dated August 14, 2008, and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated April 7, 2008, or as otherwise approved by the Planning and Development Department;  the retention pond shall be enclosed with a black or dark green metal picket-style fence and the minimum height shall be in accordance with the City of Jacksonville Ordinance Code;  the development shall be substantially similar to the architectural elevations dated August 14, 2008;  and at the time of verification of substantial compliance of the PUD, the developer shall submit a lighting plan, including fixture types and foot-candle illumination, for the review and approval of the Planning and Development Department.

Corrects a scrivener’s error by removing an unneeded closing parenthesis in the title; corrects an error in the quoting of existing Ordinance Code language (existing Ordinance Code subsection reads “Agriculture Department employees who participated in the Florida Retirement System” rather than “The Agriculture Department”).

Amendment

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated June 26, 2008, and a revised PUD Site Plan dated July 2, 2008, and adds the following condition to the PUD:  at the time of verification of substantial compliance of the PUD, the developer shall submit a final landscaping plan subject to the review and approval of the Planning and Development Department, and the final landscape plan shall show an 18-inch evergreen hedge along Edgewood Avenue from the western property line to the existing entrance in addition to one 2-inch DBH evergreen tree.

Amendment

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated June 3, 2008, or as otherwise approved by the Planning and Development Department; and shade and/or evergreen trees, at least 4-inches caliper, shall be planted for every 25 feet and spaced not greater than 40 feet on center along the Jammes Road frontage and northern property line.  The Amendment also corrects a scrivener’s error to reflect the original Site Plan dated April 20, as opposed to April 2.

Updates reference to the Director of Health, Welfare, and Bio-Environmental Services with reference to the Director of the Environmental Compliance Dept.; concerning certain JEA and Water and Sewer Expansion Authority authorization, removes meaning of the term Director of Public Utilities; clarifies issuance of a riding academy permit by stating Duval County Health “Department;” correctly updates a listing of certain jurisdictional agencies relative to building code permitting by changing reference to the Regulatory and Environmental Services Dept. to “Environmental and Compliance” Dept. rather than to “Planning and Development” Dept.; due to changes made in another ordinance, strikes certain proposed updates to Groundwater Resource Management provisions; relative to the granting of a certificate of public convenience and necessity for solid waste management, provides for referral of legislation to the “City Council committee to which matters regarding public utilities are referred” (rather than to the “Public Utilities Committee”); updates reference to such certificate issuance by replacing “Regulatory and Environmental Services” with “Environmental and Compliance” (rather than “Public Works”); due to changes made in a prior ordinance, omits certain proposed updates to garbage service charge provisions; clarifies a reference to the “Health Department” by stating “Duval County Health Department;” due to changes made by previous legislation, omits certain proposed updates to various regulations concerning airports and adjacent lands, and to the Airport Zoning Advisory Committee.

Amendment

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated June 19, 2008, or as otherwise approved by the Planning and Development Department; there shall be a 20-foot landscape buffer on the western property line;  10 feet of the 20-foot landscape buffer shall be west of the existing wall, and 10 feet shall be east of the existing wall for a total of 20 feet;  on the east side of the existing brick wall along the western property line, the development shall contain an evergreen screen consisting of 3.5-inch caliper, 65-gallon Florida Fancy trees, spaced 7 feet on center;  permitted trees include southern magnolia, southern red cedar, and Nellie Stevens holly;  there shall be one double-sided, internally- or externally-lit monument sign not to exceed 15 feet in height and 50 square feet in area along Duval Station Road and located a minimum of 100 feet from the western boundary of the property; there shall be one double-sided, internally- or externally-lighted monument sign not to exceed 8 feet in height and 24 square feet in area along Lady Lake Road and located a minimum of 100 feet from the western boundary of  the property;  the architecture of the building shall be consistent and compatible with the existing shopping center and shall have a metal seam pitched roof to match that of the adjacent convenience store to the east, subject to the review and approval of the Planning and Development Department at the time of verification of substantial compliance of the PUD;  the prohibited uses in the PUD include a liquor store, a tattoo parlor, and/or an adult novelty book store;  the building on the subject property may face north, south, east, or west;  to confirm no migration of light to the residential parcel, the developer shall submit, at the time of verification of substantial compliance of the PUD, a lighting plan, including fixture types and foot-candle illumination, for the review and approval of the Planning and Development Department.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated July 7, 2008, and a revised PUD Site Plan dated July 23, 2008, and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated June 23, 2008, or as otherwise approved by the Planning and Development Department; ground-mounted or monument-style signage shall be externally illuminated only; and prior to verification of substantial compliance of the PUD, the developer shall submit architectural elevations of the townhome and condominium buildings for the review and approval of the Planning and Development Department.
