Substitute

Provides for new employees hired on or after the first full pay period after March 1, 2009, to choose the Defined Contribution Plan or General Employees Retirement Plan, and then have three opportunities to transfer from one plan to the other within the first five years of employment; revises dates relative to purchases of service, time connections, and effective date of the Defined Contribution Plan; provides a new Part 6 concerning a City Disability Program, with certain current disability provisions to no longer be effective upon implementation; details membership in the Defined Contribution Plan and provides for changes; provides for new employee election of plan (Defined Benefit or Defined Contribution), with failure to make a timely election deemed election to enroll in the Defined Benefit Plan; provides for training at new employee orientation and continuing education programs; revises provisions for members of the Defined Benefit Plan who elect to transfer to the Defined Contribution Plan; requires that retiree members of the Defined Contribution Plan be entitled to participate in the City’s health insurance plan in the same manner as a retiree of the Defined Benefit Plan, with criteria to be met; revises attachments; makes other clarifying and technical changes.

Amendment

Per Office of General Counsel,  the Amendment incorporates a revised PUD Written Description dated August 5, 2008, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division Memorandum dated April 17, 2008, or as otherwise approved by the Planning and Development Department;  multifamily structures which face or “back up” to each other shall have at least forty feet of separation between the structures;  multifamily structures shall have a minimum separation of twenty feet between the end walls and twenty feet between an end wall and a face or a rear of another multifamily structure.

Amendment

Per the Office of General Counsel, the Amendment changes the requested Land Use Category to Public Buildings and Facilities (PBF) as opposed to the original request for Residential-Professional-Institutional (RPI); strikes and replaces Exhibit 2 (Map) to reflect PBF instead of RPI.

Substitute

Revises recitals; states additional purpose of ordinance to provide time for certain analysis and reporting; provides for a timeline to be given to the Finance Committee by August 18, 2008, for next year’s RFP; provides for submission of a quarterly report to the Finance Committee on the status of next year’s RFP beginning September 1, 2008, including evaluation of self insurance for health benefits, the results and progress of the Simple Steps program, and the feasibility of combining other governmental agencies into one contract; provides that the contract amendment will not be submitted to the City’s Professional Services Evaluation Committee; clarifies reasons for waiver of certain Ordinance Code provisions and reflects the City’s desire to complete a thorough analysis of alternatives to existing service models.

Per the Office of General Counsel, the Amendment strikes and replaces Exhibit 1 to correct the Legal Description and update the following in the bill to reflect the new Legal Description:   update the address to add a portion of 2510 New Berlin Road; update the Real Estate Numbers to add a portion of R.E. No. 106508-0010; and update the acreage amount to reflect the new total of .92 of an acre.  The bill will be renoticed and readvertised based on the new Legal Description.

Per the Office of General Counsel, the Amendment grants the Waiver of Road Frontage for property at 461 Tresca Road in Council District 1 subject to the following condition:  the developer/owner shall repair the potholes on Tresca Road from the end of the City-maintained portion of Tresca Road to the developer/owner’s property.

Reflects in the bill title the appropriation of funds from a JHFA Investment Pool Earnings account; provides for an amended BT.

Creates a Bartram Park DCSB DRI Revenue Fund to receive the Education Mitigation-Educational Assessment Fees for the Bartram Park Development of Regional Impact.

Per the Office of General Counsel, the Substitute removes references to the Settlement Agreements at the request of the Department of Community Affairs.  The bill repeals all Ordinances related to the Timucuan DRI and if approved, the Department of Community Affairs will dismiss the pending court cases (as opposed to requiring that the City enter into Settlement Agreements on a matter that the City Council has repealed).
