Amendment

Per the Office of General Counsel, the Amendment strikes and replaces Exhibit 1 and Exhibit 2 to incorporate a Revised Legal Description dated February 27, 2008, a Revised PUD Written Description dated May 1, 2008, and a Revised PUD Site Plan dated May 1, 2008, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated February 25, 2008, or as otherwise approved by the Planning and Development Department;  a twenty-foot-wide natural buffer around the perimeter of the subject property shall remain undisturbed;  and any future buildings must be reviewed and approved through a rezoning application.

Per the Office of General Counsel, the Amendment strikes and replaces Exhibit 3 to incorporate a Revised PUD Written Description dated June 11, 2008, and a Revised PUD Site Plan dated June 11 (note that the Revised Legal Description was previously attached by Amendment on 5/27/08) and adds the following conditions to the PUD:  no maintenance, repair, or body shop uses are permitted on the western 100 feet of the subject property;  the 35-foot setback buffer along the west property line shall contain a four-inch DBH evergreen tree planted every twenty-five feet along any portion of the boundary which contains an uncomplementary land use;  all other planting and visual screening requirements of Section 656.1216 of the Zoning Code shall apply;  and no signage on Townsend Boulevard is permitted within 100 feet of residentially zoned property.

Per the Office of General Counsel, the Amendment adds the following conditions to the Resolution for Transmittal to the Department of Community Affairs:  Prior to adoption of the subject Land Use Map Amendment, the developer shall meet with the applicable Citizens Planning Advisory Committee to present the details of the proposed project.  Additionally, the developer shall address buffering issues in the proposed Planned Unit Development companion rezoning.

Per the Office of General Counsel, the Amendment clarifies that the light industrial uses will be “warehouse/distribution” uses and limits the location of certain uses as follows:  the 6.0 acres of CGC uses shall be clustered in the northeast corner of the Regional Activity Center fronting Lem Turner Road and the 172.35 acres of LDR uses shall be clustered in the northwest corner of the Regional Activity Center with primary access at Braddock Road;  and attaches a map showing the above limitation on location of uses as Exhibit 3.
