Amendment

Per the Office of General Counsel, the Amendment limits occupancy of a special use facility to the applicable occupancy limitations required by federal, state, or local laws, adds number of hospitable rooms to the list of information submitted to Planning Director, and amends WHEREAS clauses to conform to current text of bill.

Amendment

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated April 21, 2008, and a revised PUD Site Plan dated April 18, 2008, and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated October 15, 2007, and FDOT approval, or as otherwise approved by FDOT and the Planning and Development Department;  disclosure regarding the proximity to the firing range/gun club shall be identified on the plats and disclosed in the sales documentation; maximum lot coverage shall not exceed 50 percent;  prior to verification of substantial compliance of the PUD, an amenity plan for the recreation area shall be submitted for review and approval by the Planning and Development Department; the entry road shall be sixty feet wide and provide opportunities for cross-access; and the developer shall provide masonry products as accents on the front of all homes, and shall provide masonry products on the sides and backs of the buildings directly facing street frontages, masonry product means cement siding, stucco, brick, stone, or any combination of these products;  all vinyl siding used for exterior cladding shall be Variform Contractors Choice or equivalent with a minimum thickness of .04 inches.

Omits reference in title to countywide application; revises Environmental Protection Board ticketing authority provisions; revises definitions; includes fertilizers containing phosphorus in certain prohibitions; clarifies fertilizer content and application provisions; includes provisions relative to impervious surfaces, fertilizer free zones, low maintenance zones, and mode of application; revises exemption, public education, training, recordkeeping, and storage provisions; makes other technical changes.

States that Chapter 366, part 5, is repealed and recreated; requires the director to cooperate with the St. Johns River Water Management District and all utilities located in Duval County in water conservation planning for Duval County; defines the term “micro-irrigation system;” clarifies and expands landscape irrigation schedule provisions; clarifies provisions for exceptions and variances; revises penalty provisions, with a second violation resulting in a $50 ticket and a subsequent violation resulting in a $250 ticket; clarifies customer notification provisions; makes other technical changes.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated April 29, 2008, and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated April 8, 2008, or as otherwise approved by the Planning and Development Department;  any improvements to the right-of-way, which include striping, shall be subject to the review and approval of the Development Services Division and the Planning and Development Department; if the project is 100% multifamily residential uses, then the monument sign shall be externally illuminated and no greater than 32 square feet in area and 12 feet in height; and if the project contains commercial office space, then the monument sign shall be externally illuminated and no greater than 80 square feet in area and 12 feet in height.

Per the Office of General Counsel, the Amendment grants the sign waiver permitting a reduction in the minimum set back for signs from ten feet to zero feet at 2304 St. Johns Bluff Road.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated April 15, 2008, or as otherwise approved by the Planning and Development Department; and one externally illuminated monument sign shall be permitted not exceeding 48 square feet in area and 12 feet in height.

Per the Office of General Counsel, the Amendment incorporates additional acreage to reflect the entire Lexus/Mercedes PUD for rereferral and readvertising; strikes and replaces Exhibit 1 to reflect new legal description and new total acreage in the bill (34.85 as opposed to .85).

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated May 7, 2008, and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated April 4, 2008, or as otherwise approved by the Planning and Development Department; at the time of verification of substantial compliance with the PUD, the developer shall provide building elevations showing material selections, subject to the review and approval of the Planning and Development Department and such materials shall be consistent with the Oceanway Town Center Initiative Corridor Study; site identification signs shall be limited to two monument signs on New Berlin Road and one monument sign on Gillespie Avenue; the signs shall not exceed 15 feet in height and 150 square feet in area each and shall be at least 100 feet from any residentially-zoned property.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated April 16, 2008, or as otherwise approved by FDOT and the Planning and Development Department; at the time of verification of substantial compliance of the PUD, the developer shall submit a site plan showing preservation of all trees 6” DBH or greater for the first twenty feet outside the right-of-way along Duval Road and Woodland Drive, except where providing access; there shall be a twenty foot buffer between uncomplementary uses along the southern property line where adjacent to a residential zoning district; Parcel A is permitted one double-sided, internally or externally illuminated monument sign not exceeding 25 feet in height and 120 square feet in area; Parcel B is permitted two internally or externally illuminated monument signs not exceeding 25 feet in height and 100 square feet in area; all signs shall be at least 100 feet from residential property lines and 100 feet from another sign.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated April 7, 2008, or as otherwise approved by the Planning and Development Department; any cross-access interconnectivity with the property to the west shall be by written agreement from the property owner and provided at the time of verification of substantial compliance with the PUD; signs are limited to one directional sign not exceeding 5 feet in height and 15 square feet in area, and wall signs pursuant to Section 656.1303(j)(3) of the Zoning Code.
