Amendment

Per Office of General Counsel, Amendment incorporates a revised PUD Written Description dated April 30, 2008, and a revised PUD Site Plan dated March 17, 2008, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division transportation memorandum dated February 1, 2008, and the Transportation Planning Section memorandum of February 19, 2008, or as otherwise approved by the Planning and Development Department;  and the developer shall install a buffer along the northern boundary of the subject property consistent with the buffer diagram dated May 2, 2008, and on file in the Planning and Development Department.

Per the Office of General Counsel, the Amendment attaches a revised Exhibit 2 (Future Land Use Map) to limit development on the subject property to 15,000 square feet of light industrial uses, and corrects the reference to R.E. #000991-1000 to indicate that the subject property is only a portion of R.E. #000991-1000.

Per Office of General Counsel, Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division transportation memorandum dated March 11, 2008, or as otherwise approved by the Planning and Development Department; the developer shall install an eight-foot-tall fence on a three-foot-tall berm continuously along the Interstate-95 right-of-way;  the fence shall be durable material, other than wood, and the area shall be planted according to the landscape planting requirements for buffers between uncomplementary uses in Section 656.1216, Ordinance Code.

Per Office of General Counsel,  Amendment incorporates a revised PUD Written Description dated April 23, 2008, and a revised PUD Site Plan dated April 21, 2008, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division Memorandum dated March 12, 2008, or as otherwise approved by the Planning and Development Department;  prior to verification of substantial compliance of the PUD, a traffic study shall be performed and provided to the Planning and Development Department for review and approval, to determine the traffic signal, deceleration lane, length of median turn lanes, parking spaces for trucks, and safety impact on New Berlin Road at the project’s entrance;  all off-site roadway improvements required as a result of the traffic study, other than those included in a Fair Share Contract, shall be completed prior to issuance of a Certificate of Occupancy;  to provide interconnectivity, the Alta Lakes PUD may add additional access points to the south and east boundaries of the subject property through adjacent properties and this condition specifically supersedes anything to the contrary in the PUD Written Description dated April 23, 2008;  where the subject property is adjacent to Alta Drive, a Residential Low Density (RLD) Zoning District, or a Residential Rural (RR) Zoning District, there shall be a buffer which complies with Section J and Industrial Buffer Plans A or B, with the exception of the requirement for the six-foot masonry wall, and the buffering shall be met exclusive of the right-of-way needs for four-laning Alta Drive; and truck courts in Parcel A and Parcel C on the Site Plan dated April 21, 2008, shall not directly face either a residentially-zoned property or Alta Drive.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated February 15, 2008, and a revised PUD Site Plan dated February 24, 2007, and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated March 13, 2008, or as otherwise approved by the Planning and Development Department; and a landscape and buffer plan consistent with certain industrial buffer planting details shall be submitted for review and approval by the Planning and Development Department at the time of verification of substantial compliance of the PUD.

Per Office of General Counsel,  Amendment incorporates a revised PUD Written Description dated April 23, 2008, and a revised PUD Site Plan dated April 23, 2008, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division transportation memorandum dated March 10, 2008, and the Transportation Planning Section memorandum of March 24, 2008, or as otherwise approved by the Planning and Development Department;  the developer shall submit a traffic impact study to the Planning and Development Department and the Florida Department of Transportation for review and approval, and projects identified in the traffic impact study shall be completed prior to issuance of any building permit;  and the developer shall provide two future access points to the parcel located at the northeast quadrant of Pecan Park Road and US-17.
