Substitute

Authorizes and approves a $350,000,000 budget for the Duval County Unified Courthouse Program ($263,500,000 previously approved and proceeds of a bond issuance in the amount of $86,500,000); approves the Revised Project Description of March 31, 2008; provides for membership by the Chairman of the Jacksonville Economic Development Commission Downtown Development Review Board on the Courthouse Architectural Review Committee; revises use of funds provisions and relative exhibit; allows program contingency to be used to cover potential shortfalls on any of the Courthouse components, with the exception of prior expenses; includes CIP amendments; allows certain transfers of funds within the Courthouse program; approves multi-year funding and provides contract requirements.

Amendment

Per Office of General Counsel, the Amendment incorporates a revised PUD Site Plan dated March 19, 2008 and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated February 22, 2008 or as otherwise approved by the Planning and Development Department;  no residential uses shall be permitted; at the time of verification of substantial compliance of the PUD, the developer shall submit a landscape plan for review and approval by the Planning and Development Department and all existing trees greater than 5 inches in diameter-breast-height (DBH) within the required ten-foot-wide buffer between uncomplementary land uses along the south property line shall be preserved;  the developer shall install a wood fence, 95% opaque, and six feet in height along the south property line adjacent to undeveloped parcels and the fence shall be on the exterior line of the said buffer.

Amendment

Per Office of General Counsel, the Amendment revises the proposed Development Agreement (reserving traffic circulation capacity off Garden Street in Council District 11) to shorten the term of the Development Agreement to five years (as opposed to ten years) and revises “Exhibit H” to the Development Agreement to provide a more detailed performance schedule for the development over the five-year term of the Agreement.

Amendment

Per Office of General Counsel,  the Amendment grants Waiver of Road Frontage to reduce required road frontage from 35 feet to 0 feet off Lenox Avenue in Council District 12 subject to the following conditions:  the subject property shall not be further subdivided unless the existing access easement complies with City road standards and it is dedicated to the City as an approved public right-of-way or is an approved private right-of-way; the subject property shall be limited to 12,000 square feet of professional/business office use, which is the size of the existing building on the site;  and heavy equipment storage is prohibited.

Amendment

Per Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated March 3, 2008 and a revised PUD Site Plan dated March 3, 2008 and adds the following conditions to the PUD:  transportation improvements shall be made as approved by the Development Services Division and the Planning and Development Department;  the final location of the 20-foot-wide easement from the terminus of Irving Road to the adjacent property to the north shall be depicted on the engineering plans submitted for review and approval by the City of Jacksonville.

Amendment

Per Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated February 26, 2008 and a revised PUD Site Plan dated February 26, 2008 and adds the following conditions to the PUD:  transportation improvements shall be pursuant to the Development Services Division transportation memorandum dated February 22, 2008, or as otherwise approved by the Planning and Development Department;  a buffer between uncomplementary land uses shall be placed along the entire eastern property line between the existing residential uses and the PUD;  the maximum height of the monument sign shall be eight feet and the sign face shall be limited to 24 square feet;  illumination of wall signs is prohibited; all light fixtures, including security light, shall be cutoff fixtures and they shall be incorporated as an integral design element that complements the design, style, materials, and color of the building; all cutoff fixtures shall not have more than 1 % of their lamp lumens above the horizontal plane; all sag lenses, drop lenses, and convex lenses are prohibited;  illumination levels at all property lines shall not exceed one-half foot-candle when adjacent to residential areas or rights-of-way; house-side shields and other cutoff reflectors shall be incorporated into the lighting design to meet these design standards; to provide appropriate lighting within pedestrian areas, the maximum light pole heights in all parking areas shall not exceed fifteen feet.

Per Office of General Counsel,  the Amendment incorporates a revised PUD Written Description dated March 10, 2008 and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated February 22, 2008 and the Florida Department of Transportation (FDOT) memorandum dated March 13, 2008, or as otherwise approved by the Planning and Development Department and FDOT; the maximum potential residential development density on the subject property is limited to seven dwelling units per acre.

Per Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated March 10, 2008 and adds the following conditions to the PUD:  development shall be subject to the Development Services Division transportation memorandum dated February 25, 2008 or as otherwise approved by the Florida Department of Transportation (FDOT is referenced in the 2/25/08 memo) and the Planning and Development Department;  a traffic mitigation plan shall be submitted to the Planning and Development Department for review and approval at the time of verification of substantial compliance of the PUD.

Per Office of General Counsel, the Amendment grants the Sign Waiver to reduce the minimum setback for a sign from ten feet to four feet at 2907 North Main Street in Council District 7 subject to the following conditions:  the Sign Waiver applies to the new sign on the property only and no additional ground or pylon signs are permitted until the existing sign is removed or complies with Part 13 of the Zoning Code; the base of the sign shall be landscaped and such landscaping is subject to the review and approval of the Planning and Development Department; the overall height of the sign shall be limited to twenty feet; the sign face shall be limited to 70 square feet.

Increases the reallocated amount from $450,809.15 to $454,855.61 ($439,570.37 from Miramar Tributary Improvements and $15,285.24 from Inwood Terrace); provides for a revised B.T. and a Revised Exhibit 2 (CIP project information sheet) to correct account names and numbers; adds an Exhibit 3 (CIP project information sheets for the completed projects).
