Amendment

Amendment

Per the Office of General Counsel, the amendment adopts a revised PUD Site Plan dated January 16, 2008, and adds the following conditions to the PUD:  the development shall be subject to the Development Services Memorandum dated October 31, 2007, or as otherwise approved by the Planning and Development Department;  all sides of the building shall have architectural details, including faux windows, variations in wall planes, and contrasting banding and pilasters—furthermore, flat roofs with parapets shall have contrasting color caps and no plain concrete block is permitted—architectural elevations shall be submitted at the time of Verification of Substantial Compliance of the PUD for review and approval by the Planning and Development Department; front yard setbacks shall be at least 30 feet;  the portion of the site in the Low Density Residential Land Use Category shall not be used as a vehicle use area, except for use by emergency vehicles; no windows on the south façade shall permit a view from the interior to the exterior of the building; illumination levels at all property lines shall not exceed 0.5 footcandles and outside shields and/or other cutoff reflectors may be incorporated to meet this lighting standard; the hours of customer access shall be limited to between 7:00 a.m. and 10:00 p.m.; and the developer shall provide a buffer between uncomplementary land uses meeting the requirements of Part 12 of the Zoning Code along all property lines adjoining a residential use or a residential zoning district.

Amendment

Per the Office of General Counsel, the amendment adopts a revised PUD Site Plan dated January 24, 2008, and adds the following conditions to the PUD:  the development shall be subject to the Development Services Memorandum dated December 17, 2007, and the Transportation Planning Section Memorandum dated January 3, 2008, or as otherwise approved by the Planning and Development Department;  the maximum building height shall be two stories and 35 feet in height measured to the peak of the roof;  drive-through banks and/or restaurants may be permitted by Minor Modification to the PUD but service or filling stations and outside sales and service (other than holiday items) are prohibited;  the entrance drive shall be reconfigured with an extended throat length for uninterrupted parking lot ingress and egress; and notwithstanding anything to the contrary in the PUD Written Description dated November 20, 2007, the total enclosed square feet permitted is 72,000 square feet.

Amendment

Per the Office of General Counsel, the amendment adds the following conditions to the PUD:  the development shall be subject to the Development Services Division Memorandum dated December 9, 2007, and the Jacksonville Transportation Authority Memorandum dated December 13, 2007, or as otherwise approved by the JTA and the Planning and Development Department;  an eight-foot-high fence along the east property line is not required because the rear elevations of the storage building and landscaping pursuant to Section 656.1216 may be used to satisfy the visual screening requirements; and the development shall be subject to Section 656.401(G)(1) through (7) of the Zoning Code and a hedge shall be installed to visually screen truck storage display from 103rd Street, subject to the review and approval of the Planning and Development Department.

Amendment

Per the Office of General Counsel, the amendment adds the following conditions to the PUD:  the development shall be subject to the Development Services Memorandum dated January 23, 2008, or as otherwise approved by the Planning and Development Department;  lighting shall be designed and installed to direct downward and reflect back to the subject property to prevent glare and/or excessive light onto the surrounding property—light figures mounted on canopies shall be recessed so that the lens cover is flush with the bottom surface of the ceiling or canopy; and the development shall be subject to the City of Jacksonville Commercial Design Guidelines for elements such as architecture, lighting, signage, and pedestrian design.

Revises title to reflect that the equipment is for “copying” rather than for “printing;” corrects a scrivener’s error in the title (“needed” rather than “need”); provides for a Revised Exhibit 1 (IKON inventory); includes language requesting emergency passage, with the stated purpose being to expeditiously effect the settlement as part of the compromise between parties.
