Revises recitals; establishes a maximum cost of $395,300,000 for the Duval County Courthouse Facilities Project; provides for a revised project description; provides for the issuance of special revenue bonds in the amount of $131,800; revises provisions concerning the Courthouse Architectural Review Committee; requires the Mayor to seek the advice and counsel of the Chief Judge and the Council President; clarifies use of funds provisions; omits certain sections concerning the appropriation of funds, including Court Cost $15 Trust Fund revenue; revises CIP amendment provisions; states that the ordinance “supersedes” (rather than “repeals”) specified prior ordinances; omits section relative to Monroe Street remaining open; attaches revised exhibits.

Per Office of General Counsel, Amendment attaches Exhibit 1, which is the recommended Final Order from the Land Use and Zoning Committee (denying the appeal and upholding the Planning Commission Final Order GRANTING the Zoning Exception to serve all alcoholic beverages in conjunction with a restaurant at 7707 Arlington Expressway).

Amendment

Per Office of General Counsel, Amendment modifies text regarding the applicability of Part 10 of the Zoning Code as recommended by the Planning Department and the Planning Commission.  As amended, previously platted or approved subdivisions with less than 50 percent of the units remaining to be built, or with 10 units left (whichever is fewer), may be built using the noise attenuation standards required when the subdivision was originally platted or approved.  The developer must provide notice to buyers if a unit is exempt under the section, as amended.

Provides for a Revised Landfill Gas Rights Agreement, which revises exhibits to correct inconsistencies with the Lease Agreement and Three Party Agreement and adds additional insurance requirements; provides for a Revised Lease Agreement, which clarifies default language to mirror the Landfill Gas Rights Agreement; and provides for a Revised Three Party Agreement, which corrects exhibits to clarify inconsistencies with the Landfill Gas Rights Agreement.

Per Office of General Counsel, Amendment adds the following conditions to the PUD:  development shall be subject to the Development Services Division memo dated December 5, 2007, or as otherwise approved by the Development Services Division and the Planning and Development Department; no outside storage is permitted; light manufacturing and processing uses within the building shall not be closer than 100 feet to the southern property line and shall not be closer than 60 feet to the western property line;  lighting shall be designed and installed to prevent glare and excessive light on adjacent residentially zoned property & the lighting plan shall be subject to the review and approval of the Planning and Development Department prior to final building permit approval.

Per Office of General Counsel, Amendment adds the following condition to the PUD:  the monument signs at 4490 and 4492 Southside Boulevard shall not exceed 15 feet in height and wall signs shall comply with Section 656.1303(c)(J)(3) of the Zoning Code.

Per Office of General Counsel, Amendment attaches a revised PUD Written Description dated December 10, 2007, and adds the following conditions to the PUD:  development shall be subject to the Development Services Division memo dated December 5, 2007, or as otherwise approved by the Development Services Division and the Planning and Development Department; the outdoor sale and service of food and alcohol is permissible by zoning exception only;  one monument sign is permitted and it may be externally illuminated and double-faced, but it shall not exceed 15 feet in height and 100 square feet in area;  the buffer and fencing along the southern property line shall be installed prior to any land disturbance and building construction.

Per Office of General Counsel, Amendment attaches Planning and Development Staff Report and amends text of bill to grant the waiver of road frontage (reducing minimum road frontage from 160 feet to zero feet for two dwelling units at 12209-1 Caney Marsh Court between Dunn Creek Road and Caney Oaks Drive in Council District 11).
