(Finance) Places amended excerpt of the minutes of the Jacksonville Housing Finance Authority regular meeting of August 19, 2009, on file; requires that the ordinance include language stating that the preliminary commitment has expired and that the ordinance approves an extension to the preliminary commitment to April 1, 2010.

Amendment

Per OGC, the Amendment incorporates a revised PUD Written Description dated October 5, 2009 and a revised PUD Site Plan dated October 5, 2009 and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division Memorandum dated October 6, 2009 or as otherwise approved by the PDD;  the two existing buildings on the site shall be limited to office/institutional uses only; the second floor and any higher floor of proposed building shall be limited to office institutional uses;  the first floor on any proposed buildings may be used for retail uses;  the architectural elevations shall conform to the policies and guidelines contained in Section 1.2.1, 1.2.2 and 1.2.3 of the Jacksonville Design Guidelines and Best Practices Handbook subject to the review and approval of the Planning and Development Department; architectural elevations shall be submitted at time of PUD verification and the buildings shall be constructed of glass, brick, masonry or stucco or a combination thereof;  all sag lenses, drop lenses and convex lenses shall be prohibited; illumination levels at all property lines shall not exceed one-half (.5) foot candles (“f.c.”) when the building or parking areas are located adjacent to residential areas, and shall not exceed one (1.0) f.c. when abutting other non-residential properties; all lighting lamp sources within parking and pedestrian areas shall be metal halide or compact fluorescent; the maximum light pole height in all parking areas should not exceed twenty feet (20’- 0”); an exterior lighting design plan for each project, including a photometrics plan, pole and fixtures schedules shall be submitted at the time of verification of substantial compliance for review and approval by the Planning and Development Department;  there shall be no more than four (4) signs; each sign shall be a monument sign up to 18 feet in height with a sign face of 150 square feet; each sign may be internally or externally illuminated; monument signs on McCormick Road will be turned off by 10:00 pm; no sign is permitted on the corner of Monument Road and McCormick Road; at the time of PUD Verification the parking shall comply with Part 6 of the Zoning Code; there shall be no fast food or drive through restaurants and no self service laundries.

Amendment

Per OGC, the Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division memorandum dated October 6, 2009, or as otherwise approved by the PDD; the construction of the borrow pit may be permitted pursuant to Sections 656.903 through 656.906 of the Zoning Code;  prior to final subdivision plat approval, the borrow pit shall be retrofitted in order to comply with the Zoning Code definition of a lake or pond, however excluding the maximum depth requirement of Section 656.904 of the Zoning Code;  future access points shall be maintained to a width of at least 60 feet as shown on the site plan; these access points must be maintained for donation to the City of Jacksonville for a period of 5 years from the effective date of this ordinance; the City of Jacksonville must notify, in writing, the current owner of record of the property at that time as to the City’s wish to accept the donation during the 5 year period, and must take title within six months of the notice, unless otherwise mutually agreed;  the developer shall pay into an escrow account, established by the Duval County School Board, a per-unit portion (prior to obtaining each building permit) of $140,000.00, based upon the maximum number of units permitted in the PUD; provided, however, that the developer shall pay the total $140,000.00, plus accrued interest as defined herein, within five years of the effective date of this ordinance;  any unpaid portion of the $140,000.00 as of October 31, 2007 (this is a prior condition from 2007), shall be increased by an inflation factor of 6%, and thereafter, increased by an inflation factor of 6% on October 31 of each subsequent year; the developer may choose to pay the total $140,000.00 prior to obtaining any building permits, with no penalty.

Per OGC, the Amendment incorporates the following changes to the EAR-based text amendments to the Comprehensive Plan: amend FLUE Policy 8.2.1 to add “and shall be consistent with the City’s Coastal High Hazard Area (CHHA) policies” at the end of the Policy;  strike Map L-5/L-8 in the FLUE and Map C-3 in the CCME and replace it with the attached Map (clarifies map legend regarding types of wetlands); amend FLUE Policy 3.4.1 to strike “shall be linked” and replace with “should be linked”; add the following footnote to the MU Land Use Category in Table L-20 of the FLUE:  4 Due to the unique nature of the MU land use category, determination of need should be evaluated based upon the mix of uses provided in each MU land use category rather than the acreage need shown above for MU; conform all definitions regarding CHHA to the directives in the Final Order regarding DOAH Case Nos. 07-3539GM and 08-4193GM.
