09-252

Amendment

Per the Office of General Counsel, the Amendment incorporates a revised Legal Description dated August 25, 2009, a revised Site Plan dated July 8, 2009, and a revised Written Description dated August 25, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated September 2, 2009, or as otherwise approved by the Planning and Development Department;  There shall be no more than four (4) pumps with a total of eight (8) fueling stations;  Screening of the dumpster enclosure shall be consistent with Guidelines 1.6.3 and 1.6.4 of the Jacksonville Design Guidelines and Best Practices Handbook;  All pole lighting shall be limited to fifteen (15) feet in height and shall be consistent with Guidelines 1.7.7, D.1.12, D.1.12a, D.1.12b, and D.1.12c of the Jacksonville Design Guidelines and Best Practices Handbook, and the site planting shall be consistent with Guidelines D.1.2 and D.1.11;  The gas station canopy shall be consistent with Guidelines D.1.19 and D.1.21 of the Jacksonville Design Guidelines and Best Practices Handbook.

Substitute

Per the Office of General Counsel, the Substitute incorporates recommendations from the Downtown Design Review Board and the Planning and Development Department, and prohibits advertising on transit shelters in Riverside and Springfield Overlays/Historic Districts and in all other local or national historic districts.

Amendment

Per the Office of General Counsel, the Amendment strikes the prohibition against transit shelter advertising from the bill.  The prohibition against advertising on public pay phones is retained in the bill.

Replaces references to a term of 5 years with references to an expiration date of November 23, 2018; provides for a fair share assessment amount of $2,927,545 (rather than $1,417,911) and a revised fair share agreement; provides that this contract supersedes the fair share assessment contract approved by previous ordinances; requires that Ordinance 2008-300-E remain in effect as to all other fair share contracts to which it pertains.

Per the Office of General Counsel, the Amendment incorporates a revised Written Description dated September 15, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated August 19, 2009, or as otherwise approved by the Planning and Development Department;  Illumination levels shall not exceed .5 foot candles along the adjacent residential property line to the north for Parcel 1;  A five foot wide sidewalk shall be placed along the frontage with 118th Street to meet the 2010 Comprehensive Plan;  Service bay doors shall not face the south or the east on the two new buildings;  There shall be no outdoor speakers utilized within Parcel 2 or on the north side of the building in Parcel 1.

Per the Office of General Counsel, the Amendment incorporates a revised Site Plan dated October 5, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated August 20, 2009, or as otherwise approved by the Planning and Development Department;  All outparcels shall be developed to maximize internal traffic flow by the use of cross access agreements and access way connections;  The Developer shall submit architectural elevations to the Planning and Development Department for review and approval consistent with the Dunn Avenue and Main Street Corridor Redevelopment Plan and the Jacksonville Design Guidelines and Best Practices Handbook at the time of verification of substantial compliance;  Six (6) palm trees shall be planted at fifteen (15) foot centers along Dunn Avenue, in addition to the Part 12 required landscaping, and are subject to the review and approval of the Planning and Development Department.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated August 24, 2009, or as otherwise approved by the Planning and Development Department; A minimum six (6) foot wide sidewalk shall be provided where off-street parking abuts the single story convenience store;  The Applicant shall provide commercial landscape and buffering consistent with Guideline 1.5.20 and Figure 1.5.20a of the Jacksonville Design Guidelines and Best Practices Handbook along the southern property line and the western property line;  Screening of the dumpster enclosure shall be consistent with Guidelines 1.6.3 and 1.6.4 of the Jacksonville Design Guidelines and Best Practices Handbook;  At the time of Verification of Substantial Compliance, the Applicant shall submit building elevations which are subject to the review and approval of the Planning and Development Department;  Signage shall consist of one monument style sign not to exceed 200 square feet in area and 20 feet in height and shall not be located closer than one-hundred (100) feet from a residential property line;  All pole lighting shall be limited to fifteen (15) feet in height and be consistent with Guidelines 1.7.7, D.1.12, and Figures D.1.12a, D.1.12b, and D.1.12c of the Jacksonville Design Guidelines and Best Practices Handbook, the site planting shall be consistent with Guidelines D.1.2 and D.1.11, and the gas station canopy shall be consistent with Guidelines D.1.19, D.1.21, D.1.22, D.1.23, and D.1.27.
