09-254

Amendment

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Transportation Memorandum dated March 3, 2009, or as otherwise approved by the Planning and Development Department;  prior to issuance of a certificate of use, the entire site shall be brought into compliance with Part 12 of the Zoning Code;  the owner shall obtain a conversion of use permit for the existing building proposed for church uses;  no maintenance of buses is permitted on the site;  and buses shall turn right into the property and left out of the property accessing University Boulevard from Terry Road.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division Transportation Memorandum dated August 6, 2009, or as otherwise approved  by the Planning and Development Department;  and on-site lighting structures shall be limited to 20 feet in height with full cutoffs and shall be designed and installed to localize illumination onto the subject property and minimize unreasonable visual interference and impact onto any adjoining properties.

Amendment

Per the Office of General Counsel, the Amendment GRANTS the Appeal subject to the following conditions: Property owner would be allowed to secure and maintain the property for a period of three (3) years from the adoption date of Resolution 2009-694;  Maintaining the property shall include securing all building openings against unauthorized access; maintaining the property, itself, to prevent the unauthorized accumulation of vegetation, trash or debris, erasing graffiti in a timely manner and otherwise maintaining the property in a safe and reasonably clean manner;  Property owner shall certify that repairs have been made to the balcony so that it is safe and is not otherwise a danger to the public;  Electrical utilities shall be disconnected until an electrical safety inspection has been conducted by a licensed electrician;  Pursuant to section 307.110(a), Ordinance Code, complying with all the above conditions shall constitute proper corrective action to satisfy Chapter 518, Ordinance Code, as applied to the current condition of the building;  This agreement will not affect the City=s ability to respond to substantial changes in circumstances as applied to this building after the effective date of this agreement;  If, after the three-year time period identified in this agreement, the property owner has not either sold the property or is not in the process of significant renovations to rehabilitate the property, the owner shall be allowed to re-apply for a certificate of appropriateness for demolition. This agreement shall not constitute competent, substantial evidence to support or oppose a subsequent demolition certificate of appropriateness;  The property owner may, at any time, utilize any portion of the building (which may include restoring utilities) so long as that portion of the property has been certified through permitting or other inspection, that it is in compliance with all applicable codes and requirements pertaining to such use; and this agreement shall be personal to the current owner of the property, and shall not be transferrable to new or subsequent purchasers.
