Amendment

Per the Office of General Counsel, the Amendment incorporates a revised Legal Description (technical correction), a revised PUD Written Description dated August 25, 2009, a revised PUD Site Plan dated August 25, 2009, and corrects a street name, and adds the following condition to the PUD:  if there is any inconsistency between the written description and the site plan for Part 6 requirements, the site plan shall prevail.

Per the Office of General Counsel, the Amendment GRANTS the Sign Waiver at 3634 Rogero Road in Council District 1 to reduce the minimum distance between signs from 200 feet to 170 feet for two existing signs.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated August 28, 2009, and adds the following conditions to the PUD: development shall proceed in accordance with the Development Services Transportation Memorandum dated July 13, 2009, or as otherwise approved by the Planning and Development Department; and at the time of verification of substantial compliance, the developer shall submit a lighting plan, including fixture types and foot-candle illumination, for the review and approval of the Planning and Development Department.

Per the Office of General Counsel, the Amendment changes the requested land use category to Community General Commercial (CGC) as opposed to the original request to Light Industrial (LI) and updates the attachments accordingly.

Per the Office of General Counsel, the Amendment changes the requested zoning district to Commercial/Community General-1 (CCG-1) as opposed to the original request to Industrial Light (IL) and updates the attachments accordingly.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated August 6, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services Division Transportation memorandum dated July 22, 2009, and the Transportation Planning Section memorandum dated July 24, 2009, or as otherwise approved  by the Planning and Development Department;  identity monument signs shall be limited to two signs along Pecan Park Road and two signs along Main Street;  the two signs on Main Street shall be located on the parcel that directly fronts Main Street;  each sign shall be limited to 200 square feet in area and 20 feet in height;  signs shall be separated by at least 200 feet;  one additional 50-square-foot sign, 12 foot-high directional monument sign may be permitted at the access parcel along Main Street;  wall signs shall comply with Part 13 of the zoning code and may also be oriented toward Main Street;   wall signage oriented toward Main Street shall be designed and installed so as to prevent glare or excessive light on adjacent residential properties.

Omits reference in title to expected department savings of at least $500,000 and other efficiencies; includes an additional recital concerning the employee cap and part-time hours being effected during the budget process; exempts from civil service doctors and managers (rather than employees) in the Division of Health Services in the Sheriff’s Department of Corrections; requests that the Sheriff work closely with the City’s Risk Management Division to develop protocol to minimize and reduce risk associated the operation of health facilities and the provision of health services.

Includes the Jacksonville Economic Development Commission (JEDC) as a requestor of this legislation; removes language relative to waiver of various Ordinance Code sections; includes a recital and other language concerning JEDC approval of a resolution requesting Council approval of the Economic Development Agreement and the Purchase and Sale Agreement; attaches said JEDC resolution as Exhibit 3; omits certain language concerning BT 09-164 and its labeling; reduces the stated appropriated amount from $4,300,000 to $1,000,000; strikes current Section 8 concerning the waiver of conflicting ordinances; provides for exemption pursuant to Section 122.421(g); corrects authority granted to the JEDC Executive Director relative to extension of execution period (original 180-day (rather than 90-day) execution period).
