Amendment

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  should a cache of artifacts or evidence of Colonial era structures be encountered, work should stop immediately and should not continue without notification to and approval by the Florida Department of State, Division of Historic Resources;  tree removal and landscaping shall be subject to Part 12 of the Zoning Code.

Amendment

Per the Office of General Counsel, the Amendment adds text to the bill and the attached map to limit development to 350,000 enclosed square feet of light industrial uses which generate no more than 30 PM Peak Hour trips, to require a traffic study and development agreement for any trips over 30 PM Peak Hour trips, and to require interlocal agreements between the Town of Baldwin (utility services) and Nassau County (safety services).

Amendment

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  buffers along the north and east property line shall be undisturbed natural buffers;  two freestanding signs may be placed within the 25-foot landscape buffer adjacent to I-10, the signs shall be limited to 200 square feet in area and a maximum height of 45 feet, selective planting and clearing within the buffer area for maintaining sign visibility shall be subject to the review and approval of the Planning and Development Department;  development is limited as follows:  development limited to 350,000 enclosed square feet of light industrial uses which generate no more than 30 PM Peak Hour trips, a traffic study and development agreement is required for any trips over 30 PM Peak Hour trips, and interlocal agreements are required between the Town of Baldwin (utility services) and Nassau County (safety services).

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated August 6, 2009, and adds the following conditions to the PUD:  truck stops, pari-mutuel betting and racetracks shall be permitted subject to the review and approval of the Planning and Development Department with respect to the Jacksonville Design Guidelines and Best Practices Handbook, the North Jacksonville Shared Vision and Master Plan, and the locational criteria of the future land use element;  perimeter and on-site lighting shall conform to Section 1.7 of the Jacksonville Design Guidelines and Best Practices Handbook provided that the pole height under Section 17.13 is limited to 45 feet, and Section 17.114 shall not apply;  a portion of the proposed PUD is partially located in the 50-foot civilian height and hazard limitation zone for the Jacksonville International Airport and is situated directly in the flight path of Runway 7-25.  The applicant shall obtain written approval from JAA for height in excess of 50 feet and pursuant to FAA circular AC 150/5200-33B, hazardous wildlife attractants on or near airports, and the JAA shall be consulted for construction of storm water ponds or other wildlife attractants within 10,000 feet of an active runway.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated July 23, 2009, and a revised PUD Site Plan dated July 15, 2009, and adds the following condition to the PUD:  development shall proceed in accordance with the Development Services Division transportation memorandum dated July 9, 2009, or as otherwise approved by the Planning and Development Department.

Per the Office of General Counsel, the Amendment changes the limitation on commercial uses in the text of the bill from 200,000 square feet to 350,000 square feet.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated August 6, 2009, and a revised PUD Site Plan dated July 17, 2009, and adds the following condition to the PUD:  development shall proceed in accordance with the Development Services Division transportation memorandum dated July 22, 2009, and the Transportation Planning Division memorandum dated July 4, 2009, or as otherwise approved by the Planning and Development Department and development shall proceed in accordance with the Recreation and Community Services Department memorandum dated August 3, 2009, as amended as follows:  a 25-foot undisturbed natural vegetative buffer shall be maintained and the developer agrees that it will not install a fence along the property line to preserve the viewshed, unless otherwise agreed to by the Recreation and Community Services Department and the developer.

Clarifies the acquisition of fee “simple” parcels; replaces certain references to “pond site” with “Pond Site Parcel;” provides for reservation of a permanent easement over a portion of the Pond Site Parcel; clarifies Parcel 800 being as and for a drainage easement; identifies Exhibit 1 as the Option; revises a real estate number (167132-1100 rather than 162131-0050); clarifies authorization to execute documents by referencing terms and conditions of the option.

Clarifies note is for the Baptist Medical Center “Project;” revises findings to reflect (1) publication of notice not less than 14 days prior to the public hearing, (2) that said public hearing provided a reasonable opportunity for interested persons to express views, both orally and in writing, and was held in a convenient location, and (3) that proof of publication will be kept on file with the Secretary of the Jacksonville Health Facilities Authority; waives rating requirements of Section 490.108; waives compensation requirements of Section 104.305; includes a repealing clause; makes other technical and clarifying changes.
