Amendment

Per the Office of General Counsel, the Amendment incorporates a revised Site Plan dated May 14, 2009, and a revised Written Description dated May 14, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated May 7, 2009, and the JTA memorandum dated May 19, 2009, or as otherwise approved by the Planning and Development Department;  at the time of verification of substantial compliance, the applicant will be required to submit finalized building elevations subject to review and approval by the Planning & Development Department;  and pawn shops and/or tattoo parlors are prohibited.

Amendment

Per the Office of General Counsel, the Amendment GRANTS the Waiver of Road Frontage at 3850 Aladdin Terrace subject to the following condition:  prior to issuance of a building permit for the second dwelling, a private road cul-de-sac access easement meeting City standard dimensions shall be recorded, and the easement shall be improved using low-impact design standards subject to Planning and Development Department review and approval.

Amendment

Per the Office of General Counsel, the Amendment GRANTS the Waiver of Road Frontage at 4086 Green Acres Lane subject to the following conditions: there shall be no more than two dwelling units on the combined subject property of 6.5 acres;  the property address and directions shall be clearly posted from the right-of-way at Green Acres Lane in order to notify emergency responders of the property location; there shall be no further subdivision of the subject overall parent tract of 6.5 acres of land;  the applicant shall provide an undisturbed natural buffer of at least fifty feet between the back portion of the subject property and the property owned by Mr. Lamoureux.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Site Plan dated June 1, 2009, and adds the following condition to the PUD:  the four wall signs facing Atlantic Boulevard shall be externally illuminated and shall not exceed twenty square feet each.

Per the Office of General Counsel, the Amendment  incorporates a revised PUD Written Description dated June 3, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated May 4, 2009, or as otherwise approved by the Planning and Development Department;  a single-family dwelling shall be a permitted use; a day care shall be permitted by the grant of a zoning exception by the Planning Commission;  the existing building footprint shall not be expanded and the existing height shall not be increased; and any cosmetology-related use may have no more than four chairs or workstations.

Provides for a fair share assessment amount of $3,238,794 (rather than $3,158,661); adds additional reserved capacity; provides for a revised fair share agreement; makes other technical corrections (change a comma to a semicolon and correct a scrivener’s error in the spelling of “reserved”).

Per the Office of General Counsel, the Amendment attaches the transcript and identifies the LUZ Amendment as the final order which GRANTS the Appeal subject to the following conditions:  the windows shall be replaced to conform with the Historic Preservation Commission's final order within 36 months;  the condition shall run with the land and the Office of General Counsel shall record the ordinance in the public record to provide notice to future purchasers.

Per the Office of General Counsel, the Amendment revises the Development Agreement to conform to the increased dollar amount cross-referenced in the companion Fair Share Application, which was Amended and Approved by the TEU Committee.

Includes recitals; approves and adopts revisions to the Jacksonville/Duval County Affordable Housing Assistance Program Local Housing Assistance Plan, adding a new program; approves submission of amended New Plan and further action, including non-substantive revisions necessary to receive approval; revises carryover provisions to permit carryover from year to year (rather than being limited to the 2009-2010 fiscal year); clarifies the nature of the requested emergency action.
