Amendment

Per the Office of General Counsel, the Amendment attaches a Final Order Remanding the Appeal back to the Historic Preservation Commission subject to the following condition:  The Historic Preservation Commission shall consider all available options regarding the subject property, and all available evidence regarding the subject property.

Amendment

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated June 2, 2009, and a revised PUD Site Plan dated February 23, 2009, and adds the following conditions to the PUD:  a right in/right out entrance/exit may be permitted on Dunn Avenue, subject to approval by the Florida Department of Transportation; landscaping shown on the February 23, 2009, site plan shall be relocated to provide for the construction of the right in/right out facility, subject to review and approval by the Planning and Development Department; the full access driveway to Briarcliff Road East shall be located across from the existing driveway at the Publix shopping center; access to Wake Forest Avenue shall be located at least 100 feet from the edge of the outside travel lane of Dunn Avenue, and shall be designated that a left turn out is prohibited; one internally or externally illuminated sign, not exceeding 200 square feet in area and 35 feet in height, is permitted. Wall signs may face Dunn Avenue and Briarcliff Road East only; all sag lenses, drop lenses, and convex lenses shall be prohibited.  Illumination levels at all property lines shall not exceed ½ footcandle when the building or parking areas are adjacent to residential uses, and shall not exceed one footcandle when abutting non-residential properties.  All lighting lamp sources within the parking/pedestrian areas shall be metal halide or compact fluorescent. The maximum light pole height in all parking areas shall not exceed 30 feet.  An exterior lighting design plan for each project, including a photometrics plan and pole fixture schedules, shall be submitted at the time of verification of substantial compliance of the PUD for review and approval by the Planning and Development Department.

Amendment

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated April 30, 2009, and a revised PUD Site Plan dated April 28, 2009, and adds the following conditions to the PUD:  the development shall be subject to the Development Services Division Transportation Memorandum dated March 3, 2009, and the Transportation Planning Section Memorandum dated March 25, 2009, or as otherwise approved by the Planning and Development Department;  the developer shall provide a JTA approved mass transit stop/shelter within the Duval Road right-of-way; and landscaping and signage shall be substantially consistent with the conceptual drawings in the approved written description, or as otherwise approved by the Planning and Development Department.

Reduces the appropriated amount from $305,269.85 to $290,077.06; provides for a revised BT and revised CIP documentation; attaches as Exhibit 3 an itemized listing of trees and costs.

Amendment

Per the Office of General Counsel, the Amendment incorporates a revised PUD Site Plan dated May 11, 2009, and adds the following conditions to the PUD:  the development shall be subject to the Development Services Division Transportation Memorandum dated April 28, 2009, or as otherwise approved by the Planning and Development Department and FDOT; the height of the masonry wall shall be no greater than six feet; the two existing trees on the west property line shall be preserved; the refuse enclosure shall be enclosed by a masonry wall on three sides with gates to shield dumpsters or garbage receptacles from view.  It shall have a roof or covering of asphalt shingle, metal or corrugated plastic and shall not exceed six feet in height; and the sale and service of beer and wine for on-premises consumption in conjunction with the service of food which is ordered from a menu and prepared and served and paid for consumption on premises is a permitted use. The retail sale and service of all alcoholic beverages for on-premises consumption in conjunction with the service of food which is ordered from a menu and prepared and served and paid for consumption on premises shall be permitted with the grant of a zoning exception by the Planning Commission.

Per the Office of General Counsel, the Amendment grants the Sign Waiver for an existing sign at 3616 Cardinal Point Drive to reduce the setback to 3.35 feet.
