Per the Office of General Counsel, the Substitute adds acreage to the proposed Small Scale Land Use Map Amendment (requesting CGC Land Use), revises the Legal Description and attached Map to reflect the additional acreage, and revises the cross-reference to the companion rezoning to reflect a PUD application.  The bill will be readvertised and renoticed as Substituted.

Per the Office of General Counsel, the Substitute adds acreage to the proposed rezoning, revises the Legal Description and attached Map to reflect the additional acreage, and changes the requested rezoning to Planned Unit Development (as opposed to the original request to CCG-1).  The bill will be readvertised and renoticed as Substituted.

Changes certain references to “City of Jacksonville” to “Duval County;” includes provision for 75% of the available points to be awarded for businesses with secondary offices continuously located in Duval County for 60 months prior to the request for proposals and which have a minimum of 12 employees assigned to that office over the previous 12 months prior to the request for proposals.

Provides for a Second Amended BT; relative to appropriation, attaches an Exhibit 4 to include only those vehicles previously approved by Council during the budget process; omits certain proposed Ordinance Code revisions concerning auto allowances for various Constitutional officers; attaches an Exhibit 3 which reflects stricken provisions of the Ordinance Code.

Per the Office of General Counsel, the Amendment adds the following condition to the PUD:  the total sign-face area on the existing monument sign shall not exceed 64 square feet, no electronic message devices are permitted, wall signage shall not exceed 140 square feet facing Hodges Boulevard, and no signage is permitted on the sides of the building.

Reduces the stated maximum net project funds from $342,913,226 to $342,589,226; provides for a Revised Exhibit 1 (Budget Schedule B4), which specifies the items that comprise the Banking Fund Project; states that the debt to be issued to finance the project is expected not to exceed an aggregate principal amount of $3,421,309 (rather than $3,745,309).

Per the Office of General Counsel, the Amendment grants the Waiver of Road Frontage for a commercial outparcel within the Tinseltown/Deer Park PUD at 4549 Southside Boulevard in Council District 4.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  the development shall be subject to the Development Services Division Transportation Memorandum dated April 1, 2009, and the Transportation Planning Section Memorandum dated April 8, 2009, or as otherwise approved by the Planning and Development Department;  the vertical stacking of containers, bins, or trailers is prohibited;  signage is limited to one monument sign not exceeding 100 square feet in sign-face area and 20 feet in height;  the developer shall provide a 20-foot-wide buffer adjacent to the northern property line of lots on Dewitt Road—the buffer shall contain an 8-foot-high, 100% opaque vinyl fence and one evergreen tree spaced every 25 feet along the subject property owner’s side of the fence;  no access shall be permitted on Dewitt Road or Faye Road;  hours of operation shall be limited to 7:00 a.m. to 7:00 p.m., Monday through Friday;  if the residential uses adjacent to the subject property are rezoned to non-residential uses, then the buffer will no longer be required;  the developer shall provide an 8-foot-high, 100% opaque visual screen on the right-of-way on Dunn Creek Road and Faye Road;  there shall be no illumination of the subject property; the western portion of the subject property located south of the wetlands shall be used as passive space and if the area is used for storage, then the site shall contain a 20-foot-wide buffer with an 8-foot-high, 100% opaque vinyl fence with one evergreen tree spaced every 25 feet.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  the development shall be subject to the Development Services Division Transportation Memorandum dated March 23, 2009, or as otherwise approved by the Planning and Development Department and FDOT; and the freestanding monument sign shall be limited to 200 square feet in sign-face area and 20 feet in height.

Per the Office of General Counsel, the Amendment strikes and replaces the attached Exhibit 1 (Development Agreement), modifies the text of the bill to incorporate an additional CCAS Application and caps the impacts on the site to 671 P.M. Peak Hour trips.

Provides for compliance with applicable terms and conditions of the Jacksonville Housing Finance Authority’s 2008 Multifamily Bond Allocation Policies and Procedures (revised September 2008) instead of said authority’s 2007 Multifamily Bond Allocation Policies and Procedures (revised June 2007).

Corrects fund name in the title of the bill (Tree “Protection” and Related Expenses Trust Fund rather than Tree “Mitigation” and Related Expenses Trust Fund); provides for a Revised Exhibit 1 to properly reflect the number of trees being planted.

Per the Office of General Counsel, the Amendment grants the Sign Waiver at 7200 Blanding Boulevard for an auto dealership subject to the following conditions:  the signs shall be substantially consistent with the diagrams provided in the application and design changes may be approved through an Amendment to Final Order.
