Amendment

Per the Office of General Counsel, the Amendment incorporates a revised Legal Description dated April 21, 2009, a revised Site Plan dated March 5, 2009, and a revised Written Description dated March 5, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated March 13, 2009, the Transportation Planning Section memorandum dated March 16, 2009, and the FDOT memorandum dated October 20, 2005, or as otherwise approved by the Planning and Development Department and FDOT;  the development shall comply with Part 6 of the Zoning Code (parking requirements);  the signs for the commercial parcels shall not exceed 35 feet in height;  schools are not permitted on Parcel 1; the maximum building height shall not exceed 50 feet;  access to the portion of the site north of Old Gainesville Road shall be reviewed and approved at the time of verification of substantial compliance of the PUD.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated December 8, 2008, and the Transportation Planning Section memorandum dated December 3, 2008, or as otherwise approved by the Planning and Development Department; a five-foot-wide sidewalk shall be provided along St. Johns Bluff Road per the 2010 Comprehensive Plan;  free-standing signage shall be externally illuminated only and limited to monument style signage with a maximum height of 12 feet and maximum sign face area of 100 square feet.

Per the Office of General Counsel, the Amendment incorporates a revised Written Description dated March 3, 2009, attaches the transcript and identifies the LUZ Amendment as the final order and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated January 29, 2009, the Transportation Planning Section memorandum dated February 9, 2009, or as otherwise approved by the Planning and Development Department;  parking shall be provided behind the building for uses other than single-family use;  the architectural style shall be substantially similar to the surrounding residential development, subject to review and approval by the Planning and Development Department at the time of verification of substantial compliance of the PUD;  medical uses, dental uses, and clinic uses are prohibited;  operating hours are limited to between 7:00 a.m. and 7:00 p.m.;  pole lighting is prohibited and lighting shall be limited to path lighting subject to review and approval by the Planning and Development Department;  the maximum building height shall be limited to 20 feet and one story;  and refuse cans shall be used unless otherwise approved by the Planning and Development Department.

Clarifies recital concerning job opportunities by specifying that, in addition to retaining 12 full time positions, the company proposes to hire up to 18 new full time positions within 36 months of project completion; provides for a Revised Exhibit 1 (Northwest Jacksonville Economic Development Fund board minutes) to approve the project with the City lien in the third position; reflects funding for a loan of $125,000 (rather than $75,000) and a grant of $75,000 (rather than $125,000); provides for the revised Project Summary of April 20, 2009 (Revised Exhibit 3), correcting the number of jobs, reflecting third lien position, and correcting the loan amortization period; provides for the revised Redevelopment Agreement of April 20, 2009, which removes the performance schedule from the technical amendments.

Provides for lease of 2,208 square feet of finished office space at an initial annual net rate of $12.50 (rather than an initial annual rate of $13.50) per square foot; provides for lease of 1,421 square feet of unfinished office space at an initial annual net rate of $8.00 (rather than an initial annual rate of $9.00) per square foot; provides for a Revised Exhibit 1 (lease agreement) which replaces Exhibit B of the agreement to amend the rental rate schedule.

Per the Office of General Counsel, the Amendment attaches the transcript and identifies the LUZ Amendment as the final order which GRANTS the Appeal to permit the sale of all alcoholic beverages at 5941 Richard Street, subject to the following conditions:  service of food ordered from a menu shall be available at all times during the hours of operation with sit-down seating of at least 150 seats in an area of at least 2500 square feet.

Per the Office of General Counsel, the Amendment incorporates a revised Site Plan dated April 6, 2009, and a revised Written Description dated April 6, 2009, and adds the following conditions to the PUD:  externally illuminated wall signs shall be permitted on the west and north building sides, not exceeding ten percent of the square footage of the respective side of the building;  one double-faced monument sign shall be permitted, not exceeding 80 square feet in sign-face area and 18 feet in height; the sign shall be located 10 feet from the north property line and 10 feet from the west property line and the sign shall be oriented so the sign face aligns east to west.

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  a minimum six-foot-wide sidewalk shall be provided immediately adjacent to the single story convenience store where the off-street parking abuts the store;  the development shall have a commercial landscape and buffer consistent with Guideline 1.5.20 and Figure 1.5.20(a) of the Jacksonville Design Guidelines and Best Practices Handbook along the southern property line and the western property line;  screening of the dumpster enclosure shall be consistent with Guideline 1.6.4 of the Jacksonville Design Guidelines and Best Practices Handbook;  at the time of verification of substantial compliance of the PUD, the developer shall submit building elevations subject to review and approval by the Planning and Development Department;  signage shall consist of one monument style sign not exceeding 200 square feet in sign-face area and 20 feet in height;  such signage shall not be closer than 100 feet from any residential property line;  all pole lighting shall be limited to fifteen feet in height and shall be consistent with Guidelines 1.7.7, D.1.12, D.1.12(a), D.1.12(b) and D.1.12(c) of the Jacksonville Design Guidelines and Best Practices Handbook;  the site plantings shall be consistent with Guidelines D.1.2 and D.1.11 and the gas station canopy shall be consistent with Guidelines D.1.19, D.1.21, D.1.22, D.1.23 and D.1.27.
