AMENDMENTS and SUBSTITUTES

Amendment

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated January 29, 2009, or as otherwise approved by the Planning and Development Department;  the entrance on Willow Branch Road shall be designed as a “right-in/right-out” or “right-in only” entrance, subject to the review and approval of the Development Services Division;  medical clinics shall be limited to one doctor and one physician’s assistant and the following uses are prohibited:  banks, loan companies and similar financial institutions such as check cashing or payday loans, sale of food or drugs, delicatessens, bake shops, restaurants, filling stations, and retail outlets for the sale of used items, retail sale of all alcoholic beverages for on-premises or off-premises consumption;  and the visible exterior finishes of any building shall be a combination of brick, masonry, stucco, glass, wood, or metal, the code-compliant roof shall be pitched with combined guttering and may be constructed of metal, the base of the building on the south and east sides shall be masonry, block, brick, vinyl or stucco, at least four feet in height, there shall be an extended personal front door with covered portal stoop, outdoor air conditioning units shall be screened, the colors of the building shall be warm earth tones, high intensity, or pastel colors and scrambled or blotched patterns are prohibited, and the Planning and Development Dept. shall review and approve architectural materials at the time of verification of substantial compliance of the PUD.

Amendment

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated February 2, 2009, or as otherwise approved by the Planning and Development Department; all uses in the development may share the following signs:  on the west side of Duval Road-one externally illuminated monument sign not to exceed 200 square feet in sign-face area and 30 feet in height, east side of Duval Road-one externally illuminated monument sign not to exceed 200 square feet in sign-face area and 30 feet in height, along the I-295 right-of-way-four externally illuminated monument or pylon signs not to exceed 200 square feet in sign-face area each and 45 feet in height each and spaced no closer than 200 feet apart;  for interior buildings-one internally or externally illuminated monument sign not to exceed 30 square feet in sign-face area and six feet in height for each building, for wall signage--signage not exceeding 24 square feet in sign-face area per building;  the developer shall provide a forty foot wide landscape buffer along I-295 containing at least one tree (at least 2.5 inch caliper) for every 30 linear feet of roadway frontage in addition to the ten foot wide vehicle use area buffer and plantings otherwise required by Ordinance Code (existing retained plant material may be used toward this requirement);  adjacent to residential property, the developer shall provide a ten foot wide undisturbed natural buffer with a six foot high berm in addition to the vegetated buffer described in the written description and attached exhibits.

Amendment

Per the Office of General Counsel, the Amendment grants the Sign Waiver for an existing sign at 751 Lady Lake Road to reduce the minimum setback to seven feet subject to the following conditions:  future signage shall be shared or limited to a monument-style sign consistent with the size permitted in the PUD and architecturally compatible with the architecture of the building it identifies;  the 200 foot sign separation requirement may be reduced to buffer the residential uses, subject to the review and approval by the Planning and Development Department.

Substitute

Corrects the number of a cited Ordinance Code section (126.112 rather than 126.111); provides for a Fourth Revised Exhibit 1 (rules of the Human Resources and Procurement divisions, and other documents, relative to ex-offender policy); requires that, for award of a contract in the amount of $200,000 or greater, the contractor must agree in writing to cooperate in addressing the goal of securing employment for ex-offenders by compliance with Procurement Rules Regarding Ex-offenders; strikes provision relative to subcontractors.

Amendment

Per the Office of General Counsel, the Amendment adds language to the bill to allow ADA parking spaces to count towards minimum parking requirements but not count toward maximum parking requirements (so the cap on parking is not reduced).

Amendment

Per the Office of General Counsel, the Amendment strikes the attached Exhibit 1 (NOPC application dated January 13, 2009) and replaces it with a Revised Exhibit 1 (NOPC application dated April 1, 2009) and updates the title of the bill to reference the subject matter of the application:  event parking, reuse water requirements, the land use conversion table, and the timing for completion of Crosswater Parkway in St. Johns County.

Amendment

Per the Office of General Counsel, the Amendment adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated February 26, 2009, or as otherwise approved by the Planning and Development Department; the minimum yard setbacks shall be ten feet and the maximum lot coverage shall be 50%;  and the facility may be used only in connection with State and Federal Work Release Programs and the operator of the facility shall not accept any individual convicted of sexually-related offenses, pornography, or violent crimes.

Amendment

Per the Office of General Counsel, the Amendment revises the bill to indicate that the subject property is only a portion of Real Estate Number 004889-0800 as opposed to the entire Real Estate Number.

Amendment

Provides for certain input, sign placement, and approvals from the Right-of-Way and Grounds Maintenance Division (rather than the Traffic Engineering Division); provides for two (rather than one) honorary street designation signs; provides for membership on the 911 Emergency Addressing Advisory Committee from Jacksonville Fire and Rescue Communications.

(TEU) Incorporates provisions of the Rules Committee substitute; omits requirement for cooperation with specified agencies concerning Environmental and Compliance Department training workshops.

 

 

 

 

 

(Rules) Revises definitions; includes Green Building Initiative’s Green Globes rating system or Florida Green Building Coalition green building standards; omits proposed Section 327.107 and certain references thereto concerning a Sustainable Building Certification Refund Grant Program; provides owners or developers may receive a refund pursuant to the Sustainable Building Certification Refund Grant Program administered through the Environmental Protection Board; omits direction concerning Municode editor’s note; provides for an amended BT; approves and authorizes the Sustainable Building Certification Refund Grant Program as shown in an Exhibit 2.

Per the Office of General Counsel, the Amendment limits the development based upon cumulative impacts in Duval County and Nassau County and revises the attached map to indicate this limitation in Policy 4.4.3 in the Comprehensive Plan.

Amendment

Per the Office of General Counsel, the Amendment changes the name of the Regional Activity Center  to the “Northwood Regional Activity Center” as opposed to the “Northwood Town Center Regional Activity Center”;  limits the development to the following densities:  350,000 square feet of commercial uses, 125 hotel rooms, 50,000 square feet of commercial/office uses, 4,159,500 square feet of light industrial uses, 100 single-family residences, 600 multi-family residences, up to 25 acres for public buildings and facilities and a minimum of 150 acres of recreation and conservation uses; and revises the attached map to refer to the updated Policy 4.3.15 in the Comprehensive Plan.

Per the Office of General Counsel, the Amendment limits the development to 4,775,000 square feet of light industrial uses and less than 320 acres of industrial uses on the subject property (which is a total of 754 acres) and revises the attached map to include this limitation.

Revises title to reflect that the $420,000 appropriation is from Retained Earnings and that $120,000 is for Scott Park improvements; corrects and clarifies certain account names and numbers; provides for a Revised Exhibit 2 (CIP Project Information sheets); corrects and clarifies reverter provision by referencing the purpose stated in the bill.
