The meeting was called to order at 3:02 p.m. by Council President Fussell who asked the group to keep Council Member Johnson and Council Member Bishop’s daughter, both currently in the hospital, in their thoughts and prayers.

 

Council Member Webb reviewed the Rules Committee’s actions from its meeting, noting that 2009-201 (amending affordable housing assistance program to provide funding for foreclosure prevention) was recommended for approval as an emergency.

 

Council Member Corrigan reviewed the Finance Committee’s actions from its meeting.  He noted that 2009-182 (Sheriff’s Motor Vehicle Safety Program Fund) was the subject of differing amendments in the Rules, Finance and PHS committees.

 

Council Member Yarborough reviewed the Finance Committee’s actions from its meeting.  He reiterated the earlier comment about the differing committee amendments on 2009-182 and had Assistant General Counsel Peggy Sidman review the various amendment versions.  Mr. Yarborough indicated he may have a floor amendment to offer as well.

 

Council Member Graham reviewed the LUZ Committee’s actions from its lengthy meeting.  He stated that there will be a floor amendment to 2009-107 (rezoning on Fouraker Road) that will incorporate the LUZ amendment and add an additional condition.  With regard to 2009-114 and -115 (land use change and rezoning on Hendricks Avenue near San Marco) which has generated a great deal of community interest and comment, Council Member Shad requested that the Council approve the land use amendment and re-refer the rezoning to LUZ to clear up any question about the adoption process.  He noted that, although a required sign was apparently not posted in the manner prescribed, the City’s zoning regulations provide a remedy procedure which has been followed and the Council could properly act on the bill tonight.  However in an abundance of caution and to try to get the debate refocused on the merits of the rezoning proposal rather than procedural issues, Mr. Shad recommends the rereferral.  Shannon Eller noted that the bill will need to be re-noticed and re-advertised.

 

President Fussell reminded council members to please disclose their ex parte contacts at the start of the consideration of the quasi-judicial actions.

 

Council Member Jones reported that the RCD Committee’s bills were all covered by previous reports.

 

Council Member Bishop reviewed the TEU Committee’s actions from its meeting.

 

President Fussell announced that Council Member Joost would be providing dinner tonight, at his expense, from Firehouse Subs prior to the meeting.

 

There being no further business, the meeting was adjourned at 3:25 p.m.
