Amendment

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated January 5, 2009, and a revised PUD Site Plan dated January 5, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated September 4, 2008, or as otherwise approved by the Planning and Development Department; and administrative deviations from the Zoning Code shall be approved through a PUD-to-PUD rezoning process.

(TEU) Appropriates $200,000 from an Environmental Clean-up/Other Construction account to an Environmental Clean-up/Reclass Misc. Exp. account to move the funds into the appropriate sub-object; provides for a Revised Exhibit 1 (Technical Assistance Plan), which notes that there will be a Technical Assistance Plan for each of the 4 sites.

 

 

 

 

Amendment

(Finance) Appropriates $100,000 from an Environmental Clean-up/Other Construction account to an Environmental Clean-up/Reclass Misc. Exp. account to move the funds into the appropriate sub-object.

Reflects that acreage is approximately 118.17 (rather than 118.00) acres; provides for a 2nd Revised on File fair share agreement, which replaces the contract to revise Exhibit A (legal description), Exhibit C (roadway improvements), Exhibit G (description of reserved capacity), and the acreage in the contract.

Provides for a fair share assessment amount of $2,308,618 (rather than $1,763,189); provides for a revised fair share agreement, which replaces Exhibit B (fair share calculation) and Exhibit G (description of reserved capacity) to the contract.

Per the Office of General Counsel, the Amendment incorporates a revised PUD Written Description dated January 12, 2009, and a revised PUD Site Plan dated February 9, 2009, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated February 9, 2009, or as otherwise approved by the Planning and Development Department; there shall be a minimum ten-foot-wide landscaped buffer along the southern property line and within the ten-foot-wide buffer, one 3-inch-DBH evergreen tree shall be planted every 20 feet;  a six-foot-tall masonry wall shall be constructed along the south property line.

Per the Office of General Counsel, the Amendment adds the following condition to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated January 13, 2009, or as otherwise approved by the Planning and Development Department.

Amends Ordinance 2001-460-E; authorizes special counsel approved therein to charge legal fees at the maximum rate of $218 per hour for partners, $182 per hour for associates, and $88 per hour for paralegals; provides that qualified and appropriate firms shall be selected by the Office of General Counsel, from Duval, St. Johns, Clay, Nassau, and Baker counties.

Reflects that there are approximately 93 (rather than approximately 91) agreements; replaces language requiring use of FDOT Rate Schedule to determine the City’s 50% responsibility for railroad grade crossing signal maintenance costs with provision that the terms of the original agreement shall determine the City’s responsibility for such costs; provides for a Revised Exhibit 1 to replace Amendment to Agreements to reflect referenced maintenance costs.

Clarifies that the selection of smaller qualified providers “may prove to be” more effective, rather than stating “can and will be” more effective.
