Per the Office of General Counsel, the Amendment incorporates a PUD Written Description dated December 3, 2008, and adds the following conditions to the PUD:  development shall proceed in accordance with the Development Services transportation memorandum dated October 21, 2008, or as otherwise approved by the Planning and Development Department and FDOT;  the one double-faced, or two single-faced, monument signs shall not exceed 32 square feet in area;  and a twenty-foot-wide undisturbed natural buffer shall be provided along Belfort Road, the east property line, and the south property line and landscaping may be added to meet the landscape buffer required by Section 656.1212, Ordinance Code.

Revises recitals and clarifies purpose; provides for revised exhibits; allows UNF’s direct support organizations to use the premises and reduces the museum’s hours of being open to the public from 44 to 40 hours per week; authorizes delivery to UNF of an Estoppel Certificate concerning the lease; authorizes the City’s acceptance of 3 pieces of art reconveyed back to the City by MOCAJax; evidences City’s agreement to amend its reversion rights to a 4th piece of art by allowing said art to be displayed at the UNF campus after notice to the City of such new location; permits any future transfer of that art by MOCAJax to UNF upon any dissolution of MOCAJax, with UNF’s ownership of that art being subject to the same covenants and reversion rights in favor of the City.
