The committee engaged in extensive discussion about whether the bill was properly introduced for consideration given the Ordinance Code requirement that legislation proposing a pension benefit enhancement may not be introduced without a certification that the pension plan in question is at least 90% actuarially funded.  Chief Deputy General Counsel Cindy Laquidara indicated that any potential defect could be cured by means of an amendment and a 2/3 vote of Council.  The committee discussed the sustainability of the existing and proposed enhanced pension obligations given the current economic climate; Sherry Hall of the Mayor’s Office stated that a balanced budget would be presented to the Council in July, but it is too early in the budget development process to know where the additional funding for next year’s pension obligations will come from.  Several committee members expressed the difficulty of having to choose between the conflicting obligations of keeping the City’s word to the corrections officers mutually agreed to in collective bargaining and also protecting the best interests of the taxpayers in difficult economic times.

Assistant General Counsel Jason Teal explained that the case the firm was hired to handle was conducted in an extremely compressed time frame and required a great deal of work to defend the City’s interests.  In response to a question Mr. Teal stated that no one with the City had specifically authorized Greenberg Traurig to exceed the $400,000 compensation cap, but the firm was doing what it had to do to accomplish the City’s goal of defeating the permit application.  The additional $225,000 being requested is for a combination of expert witness fees ($100,000) and the law firm’s internal expenses ($125,000).

Property Appraiser Jim Overton addressed the need for the new computers, stating that is office is being asked to do more with fewer resources by both the City and state governments, and one way to achieve that goal is through improved productivity through enhanced technology.  Daryl Crooms of the Property Appraiser’s Office explained that the existing computers do not have the computing power or speed to run the newest generation of parcel mapping software.

Assistant General Counsel Tom Beverly explained that the three firms handling this work for the City were chosen by a solicitation of interest in 2001 and the billing rates have not changed since that time.  The Office of General Counsel has determined that these are fair rates, possibly somewhat less than the firms charge to non-City clients, and were established by negotiation.  The committee expressed its desire that the OGC open up the process for additional interested firms to participate in the work.

Assistant General Counsel Dylan Reingold stated that the district is being dissolved because the DRI it was intended to serve is not going to be constructed in the foreseeable future and the developer wants to avoid the costs of maintaining the district’s legal status when it serves no purpose.  In answer to questions from the committee Mr. Reingold indicated that the CDD has taken no actions that would produce any financial obligations (issuance of bonds, construction of improvements, levying of special assessments) either on the part of the district or, in the district’s absence, on the part of the City.
