Substitute

Removes certain references to agreement by applicant and to demonstration of job generation by applicant; retains reference to use of alternative formula by the Director of Planning and Development, making such use mandatory when criteria are met, and removes references to use by Council and proposal of use by applicant, Planning and Development Department, or the committee of reference; revises and clarifies criteria for calculations by alternative formula and factors relative to economic impact; establishes a points matrix for reduction in a fair share assessment.

Amendment

Includes additional recital concerning option to receive credit for new roadway connecting Lannie Road and Arnold Road; provides for a revised fair share agreement, which replaces Exhibit I (Lannie Road Extension Roadway Improvements); waives Section 655.307, Ordinance Code, to allow the credit to be calculated without using the Florida Dept. of Transportation’s transportation cost guidelines.

Amendment

Per OGC, the Amendment incorporates a revised PUD legal description dated November 16, 2010, and adds the following conditions to the PUD: (1) If the property is utilized as a residential treatment facility, the facility may be used only in connection with State and federal work release programs.  The operator of the facility shall not accept into the program any individual who has been convicted of either: (a) a sexually-related offense; (b) pornography; or (c) a violent crime; (2)  The property shall be developed in accordance with Part 12 of the Zoning Code; (3) If reclaimed water is available, the use of the Floridan Aquifer shall be prohibited as a primary source for irrigation water; and (4) The required transportation improvements shall be made in accordance with the Development Services Division Memorandum dated October 15, 2010, or as otherwise approved by the Planning and Development Department.

Concerning parties to the Memorandum of Agreement, replaces certain references to the Minerals Management Service (MMS) of the Department of the Interior with references to the Bureau of Ocean Energy Management, Regulation and Enforcement of the Department of the Interior (BOEMRE); includes authorization for technical changes to the agreement; places a revised Memorandum of Agreement on file, updating federal agency name.

Increases appropriated amount from $150,500 to $157,000 and provides for a Revised Exhibit 1 (amended BT); includes $6,500 for the Justice Coalition; revises the on file contracts and certification; waives Section 118.307(f)(7), Ordinance Code (requiring disbursement of funds on a reimbursement basis), to allow the funds to be disbursed within 30 days of the execution of the funding agreements.

Provides for a Revised Exhibit 1 (amended BT); states that Managed Access to Child Health, Inc., and the Jacksonville Children’s Commission are providing in-kind contributions in the amount of $160,647 and $49,710, respectively; attaches budget justification for the grant and commitment letters as Revised Exhibit 2, replacing Notice of Award; attaches a copy of the Jacksonville Children’s Commission minutes approving the grant and vendors as Exhibit 4.
