Requires that the property custodian (rather than Finance Dept.) file a report with the Office of Council Auditor, and provides that such report is to be made at the same time the property is reported to the Office of the Sheriff; provides for a Revised Exhibit 1 (missing/stolen property report), which deletes found property.

Per OGC, the Substitute (1) adds several whereas and severability clauses; (2) adds provisions regarding temporary election signs, free expressions signs and temporary directional real estate signs; (3) allows the substitution of noncommercial speech for commercial speech; (4) establishes the Litter Trust Account; and (5) modifies Chapter 741 concerning snipe signs and violations of the Chapter.

Amendment

Per OGC, the Amendment corrects the reference to the comprehensive plan and incorporates a revised PUD Written Description and PUD Site Plan dated May 3, 2010 and adds the following conditions to the PUD: (1) The property shall be developed in accordance with the Development Services Division memorandum dated March 30, 2010, except for comment number two, or as otherwise approved by the Planning and Development Department; (2) The building shall have a maximum height of 30 feet; (3) All landscaping in the easternmost landscape island abutting the residential driveway shall be no greater than 3 feet in height; (4) The property shall be developed in accordance with the commercial design guidelines 1.2.1 and 1.2.2 found within the Jacksonville Design Guidelines and Best Practices Handbook; (5) At Verification of Substantial Compliance, the Developer shall submit building elevation plans subject to the review and approval of the Planning and Development Department; (6) Wall signs shall not exceed 10% of the occupancy frontage facing West 21st Street. No wall signs shall be permitted to face Martin Luther King Expressway; and (7) The sidewalk shall be terminated at the easternmost landscape island.  The landscape island shall be extended south to the building.

Amendment

Per OGC, the Amendment adds the following conditions to the PUD: (1) The required transportation improvements shall be made in accordance with the Development Services Division memorandum dated March 30, 2010, or as otherwise approved by the Planning and Development Department; (2) No individual building shall exceed 40,000 square feet in size; and (3) At the time of Verification of Substantial Compliance, building elevations shall be submitted for review and approval of the Planning and Development Department.

Per OGC, the Substitute (1) changes the rezoning request from RMD-A and PBF-1 to LI to a rezoning request from RMD-A, PBF-1 and LI to PUD; and (2) increases the acreage from 2.54 acres to 2.71 acres.

Per OGC, the Amendment incorporates a revised exhibit which changes the duration of the development agreement to five years in Paragraph 5 so that it is consistent throughout the development agreement.

(RCD) Incorporates the provisions of the Finance Committee amendment and includes additional provisions to Section 7 concerning approved and required contract modifications (clarifies that the City’s $3,500,000 shall only be used for the purchase of the Hogan Lot; clarifies that the City’s commitment to pay said funds is conditioned and contingent upon JLI completing and closing the purchase of the Hogan Lot within 6 months of the effective date of the ordinance; requires that the clawback terms additionally provide for application of such terms if 300 parking spaces for the Landing are not perpetually provided on the Hogan Lot or if the Hogan Lot is sold or used for some other purpose).

 

 

 

 

 

(F) Concerning execution of agreements, includes amendments under the provisions of Section 7 of the legislation; revises appropriation section to appropriate $3,000,000 from a Metropolitan Park Improvements-Other Construction account and $500,000 from a Riverwatch Utilities account; revises appropriation section to appropriate funds to a Downtown Economic Development Fund Landing Parking account; makes appropriation contingent upon receipt of all required audited financial statements and receipt by the City of payments; removes infrastructure improvements and scope of performance from inclusion under the term “technical amendments;” adds a new Section 7 concerning approved and required contract modifications (clarifies that parking validation program commences in year 6; provides for identification of clawback terms; replaces Exhibit A to include accurate legal description; clarifies that any sale of Hogan Lot shall be approved by Council; provides for filing of completed documents with Legislative Services).
