Amendment

Per OGC, the Amendment incorporates a revised PUD Written Description dated January 5, 2010 and adds the following conditions to the PUD: 1) Development shall proceed in accordance with the Development Services Division Memorandum dated October 20, 2009, or as otherwise approved by the Planning and Development Department; 2) Development shall proceed in accordance with the JEDC Memorandum dated October 23, 2009; 3) The Development shall be subject to the City of Jacksonville Design Guidelines and Best Practices Handbook, or as otherwise approved by the Planning and Development Department; 4) Access to Old Soutel Drive shall be prohibited; 5) The applicant shall submit, at the time of Verification of Substantial Compliance, a lighting site plan showing illumination levels which shall be reviewed and approved by the Planning and Development Department; 6) The retention pond location shall be subject to the review and approval of the JEDC; 7) If the applicant installs a chain-link fence between the Subject Property and the adjacent residential property, the fence shall be installed with slats as approved by the Planning and Development Department.

Amendment

Per OGC, the Amendment incorporates a revised PUD Written Description, dated January 5, 2010, a revised site plan dated November 23, 2009, and adds the following conditions: (1) the Development shall proceed in accordance with the Development Services Division Memorandum dated October 27, 2009, or as otherwise approved by the Planning and Development Department; (2) the applicant shall submit a Lighting Site Plan, including fixture types and foot-candle illumination, for review and approval of the Planning and Development Department at the time of PUD verification of substantial compliance.  All pole lighting shall be limited to fifteen (15) feet in height and be consistent with Design Guidelines 1.7.7, and D.1.12, including all Figures D.1.12(a), D.1.12(b) and D.1.12(c) of the Jacksonville Design Guidelines and Best Practices Handbook, other than the two dumpster and underground tank locations, which may be 25 feet tall.  Furthermore, the site planting shall be consistent with D.1.2 and D.1.11.  Furthermore, the gas station canopy shall be consistent with guidelines D.1.21, D.1.22, D.1.23, and D.1.27; (3) a minimum six (6) foot wide sidewalk shall be provided where off-street parking abuts the single story convenience store; (4) the applicant shall provide a brick stucco wall, eight feet tall, with a creeping fig vine installed along the wall, located behind the service station and along the building facing Valencia Drive consistent with 1.5.20 and Figure 1.5.20(a) of the Jacksonville Design Guidelines and Best Practices Handbook.  The wall shall be constructed prior to construction of the development. Screening of the dumpster enclosure shall be consistent with guideline 1.6.4 of the Jacksonville Design Guidelines and Best Practices Handbook; (5) at the time of PUD verification of substantial compliance, the applicant shall submit building elevations which are similar to those proposed in the application as “Exhibit L”, and subject to the review and approval of the Planning and Development Department; (6) the existing pole sign on the site shall be removed and only one monument style sign shall be permitted, not to exceed 200 square feet in area and 20 feet in height; (7) outdoor speakers shall be prohibited except as otherwise required by the fire code; (8) if approved by the Florida Department of Transportation, a westbound left-turn and median break shall be provided to the apartment complex entrance east of the Subject Property as part of the roadway improvements to Atlantic Boulevard; and (9) if approved by the Florida Department of Transportation, a westbound exiting median refuge lane shall be provided as part of the roadway improvements to Atlantic Boulevard.

(Rules) Redefines City funds to exclude pass-through funding; clarifies non-cash expense; clarifies requirements regarding separate statement of City funds in audit report; revises residual funds requirement for Cultural Service Grants; adds Art in Public Places Program as ineligible for funding through Public Service Grants; expands how to determine cost effectiveness of Public Service Grants applicants; eliminates a provision limiting JEDC and JCC grants to 24%.

 

 

 

 

Amendment

(Floor) Provides for a Revised Exhibit 2 (copy of Chapter 118 reflecting changes) to include the changes made by this amendment; relative to the bank account for Cultural Service Grant funds, provides an exception allowing a remaining balance to cover any projected bank charges which would cause the bank account to fall below the minimum.

Amendment

Provides for a Revised Exhibit 1 (Second Amendment to Redevelopment Agreement), extending loan maturity date, job creation date, and extension of personal guaranty to September 1, 2012; adds an Exhibit 3 which attaches the Promissory Note and Mortgage Modification and Extension Agreement and Joinder and Consent by Guarantors; strikes references to new monthly loan payments in the amount of $1,115.00 and provides for monthly loan payments as noted in Exhibit 3.

Per OGC, the Amendment grants the waiver subject to the following condition: The address for the Subject Property shall be clearly posted at the intersection of the Lewie Mickles right-of-way and Spaner Road.

Amendment

Provides for a Revised Exhibit 1 (instructor agreement with Karen Roumillat) and a Revised Exhibit 2 (standard instructor agreement for future use), modifying provisions relative to payment terms and instructor background check requirements; states that any modification to the standard instructor agreement shall require Council approval; revises account number into which funds collected for the course are to be deposited.

Amendment

Corrects a citing of previous legislation (2005-1440-E rather than 2006-1440-E); provides for a Revised Exhibit 1 (amended and restated agreement) to correct various terms and requirements in the agreement; states that the Recreation and Community Affairs Dept. will oversee implementation of the agreement and that the Public Works Dept. will be responsible for monitoring/administering maintenance inspections at the site.
