Amendment

Provides that, at the request of the owner, the City may agree to an indemnity provision contained in the stop-station agreement in favor of the owner, with such indemnity provision to be subject to the limitations of Florida Statutes and the review and approval of the Office of General Counsel.

Provides for the Fourth Revised Exhibit 2 (amended plan maps).

Amendment

Per OGC, the Amendment approves the appeal with the following modified condition: There shall be no more than one freestanding sign on the subject property which shall be a monument style sign and which shall be no more than 200 square feet in advertising area on each side, and no more than 35 feet in height, subject to review and approval of the Planning and Development Department.

Per OGC, the Amendment incorporates a revised PUD site plan, dated June 17, 2011 and a revised PUD written description dated September 15, 2011 and adds the following conditions to the PUD:  (1) There shall be no more than 137 children in day care centers on the Subject Property; and (2) Employees shall park offsite.

Incorporates the provisions of the Rules Committee amendment; revises recitals; provides for the transfer of $775,000 (rather than $800,000) and makes other related changes; states that no hardscape or vertical improvements shall be constructed within the existing Monroe Street right-of-way, and that any sidewalk installed across the Monroe Street right-of-way shall be designed and constructed sufficient to accommodate traffic crossing said right-of-way at some future date; requires that no landscape materials, irrigation improvements, or other improvements in excess of $10,000 in value shall be installed within the existing Monroe Street right-of-way; reduces Banking Fund utilization authorization and specified account by $775,000 (rather than $800,000); provides for a Revised Exhibit 1 (CIP project information sheet).

Per OGC, the Amendment 1) adds the retail sale of all alcoholic beverages, not in conjunction with a restaurant, including liquor, beer or wine for on-premises consumption as a use by exception in the CCG-2 zoning district; and 2) clarifies that restaurants as defined in the Zoning Code include those establishments regulated by the Department of Business and Professional Regulation, Division of Hotels and Restaurants.

Clarifies statement of purpose by including language that the funds are to be used to fund Team Up programs for the 2011-2012 fiscal year.

Amendment

Provides for a Revised Exhibit 1 (executed BT); attaches a copy of the Environmental Protection Board (EPB) minutes as Exhibit 2; requires that Florida Coastal School of Law submit a financial report to the EPB within 30 days after the event, prior to the disbursement of funds; requires that said report include specified information regarding attendees (name, address, occupation, school attending as applicable, how participant heard about the conference, whether participant is a first time or returning participant, and whether participant received a scholarship in this year or in any preceding years).
