Amendment

Amendment

Per OGC, the Amendment adds the following conditions to the PUD: (1) Sale, service and display, preparation and storage shall be conducted within a completely enclosed building; (2) All dumpster(s) on the Subject Property shall be enclosed on all sides (except the gate side) with a six-foot-high solid wood or vinyl fence and a gate on one side that maintains 95% opacity.  Any gate(s) shall be prohibited from opening along any portion of the south part of the Subject Property facing Alton Avenue; (3) A five-foot-wide landscape area and perimeter landscaping meeting Section 656.1215(a)(2) of the Zoning Code shall be installed and maintained along the south property line facing Alton Avenue and the east property line facing Century Street. The installation shall be completed within one year of the effective date of this ordinance and shall be subject to the review and approval of the Planning and Development Department; and (4) There shall be no freestanding signs on the Subject Property. Only wall signs shall be permitted on the Subject Property.

Amendment

Per OGC, the Amendment adds the following conditions to the PUD: (1) The Subject Property shall be developed in accordance with the Development Services Division memorandum dated August 22, 2011, or as otherwise approved by the Planning and Development Department; (2)    The minimum setbacks for any building, structure or improvement (primary, accessory or otherwise) on the Subject Property shall be ten feet in width along the southeast property line facing Ridgewood Road and five feet in width along the southwest property line facing Spring Park Road; (3) There shall be only one freestanding sign allowed on the Subject Property which shall be a monument sign that is either double faced or single faced, and shall not exceed twenty-four square feet in area on each side, and a maximum of twelve feet in height; and (4) A six-foot-high wood fence, 95% opaque, shall be installed and maintained along the southwest property line adjacent to Ridgewood Road, subject to the review and approval of the Planning and Development Department.

Permits Council member use of the City’s communications and computer networks while in City Hall to maintain connections with private business interests so long as such use results in “no additional cost” (rather than “no special cost”) to the City; corrects Ordinance Code citing (Section “601.101” rather than “602.302”).

Removes reference to “School” from project name (“Kernan Boulevard Speed Zone Project” rather than “Kernan Boulevard School Speed Zone Project”); updates various provisions to reflect the new fiscal year, and new five-year capital improvement program fiscal period and ordinance; reflects finalized appropriation accounting; provides for a Revised Exhibit 2 (CIP project information sheet).

Reflects that the property is located on the “northwest” (rather than “northeast”) corner of Argyle Forest Boulevard and Rampart Road; reduces the fair share assessment amount from $231,474 to $168,060; provides for a revised fair share application and contract, which replaces Exhibit B, Fair Share Calculation, in the contract.
