Substitute

Provides for an increased aggregate principal amount of Banking Fund Bonds authorized to be issued by an amount necessary to provide not in excess of $59,525,982 (rather than $71,089,088) net project funds; supplements the project list to authorize additional items of capital equipment and improvements to be financed (2011/2012 Banking Fund Project Additions); includes Ordinance 2010-840-E in the listing of previous revisions; makes other technical and clarifying changes.

Deletes title reference to a continuation grant; provides for a Revised Exhibit 1 (amended BT) and a Revised Exhibit 3 (amended CIP project amendment sheet); changes referenced project name from “Phase II S-Line Rail Trail” to “S-Line Urban Greenway;” attaches a copy of the award letter as Exhibit 4.

Includes a grandfather provision relative to the Windows and Doors Specialty Contractor Certificate of Competency for individuals with at least two years of verifiable experience in that work as of June 1, 2011; provides that application for said grandfather provision must be made no later than June 1, 2012.

Per OGC, the Amendment 1) attaches the original PUD written description and first amendment to the original PUD written description, and 2) adds the following condition to the PUD: (1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated February 21, 2008 (except for items #1 and #8), or as otherwise approved by the Planning and Development Department.

Per OGC, the Substitute adds clarifying whereas clauses to explain reason current economic hardship provision is superfluous and confusing, explain that administrative approval provisions would incorporate and add to list of actions already authorized for administrative approval, and explain purpose of authorizing administrative approvals in an effort to streamline approval process for the property owner; adds clarifying language to indicate the Commission’s determination of undue economic hardship; explicitly states binding effect of Commission decisions unless there has been a substantial change in circumstances.

(RCDPHS) Incorporates provisions of the Finance Committee amendment; clarifies title to reference “special projects” rather than “miscellaneous.”

(Finance) Waives Section 804.1012(d), requiring fines be used for physically disabled persons, to allow expenditure for physical or developmental disabilities as permitted by Florida Statutes.

Reduces the stated appropriated amount from $7,103,232.38 to $3,551,616.19; revises statement of purpose to omit reference to the septic tank facilities phase-out plan, provide the amounts for the Lincoln Villas Service Area 2 improvements ($3,081,616.19) and the NAS Reclaimed Water Project ($400,000), state that the source of the funds will be from completed projects which finished under budget, and to state that a Tributary Water Quality Restoration project of $70,000 is being transferred from Environmental and Compliance to Public Works; amends the CIP to decrease budgets for the WSEA-Oakwood Villa Part 2 and WSEA-Lincoln Villas Service Area 1 projects and to establish budgets for the Lincoln Villas Service Area Sewer Improvements and NAS Jax Water System projects; attaches relative CIP project information sheets as Exhibit 4; reflects that the Second Amendment to the Agreement between the St. Johns River Water Management District and the City for Tributary Water Quality Restoration, Lower St. Johns River Basin, also includes savings from Lincoln Villas Area 1, adds a new project at Lincoln Villas Area 2, and “authorizes” the City to extend the St. Johns River Water Management District contract for up to two one-year options; includes language requesting emergency passage.

(RCDPHS) Incorporates provisions of the TEU Committee amendment; includes a recital stating that the Duval County School Board through the proposed Joint Project Agreement will reimburse the City for half of the costs, up to $50,000, of installing the school speed zone.
