Amendment

(F) Incorporates provisions of the TEU amendment; authorizes positions in the Adult Arcade Inspection Program and attaches the attendant RC as Exhibit 2; authorizes creation of a separate subfund for the Adult Arcade Inspection Program to account for fee revenue and program expenditures.

Per OGC, the Amendment incorporates a revised PUD Written Description, dated August 4, 2011, and adds the following conditions: (1) The height of the flagpole referenced in section III.C.4 of the written description shall not exceed thirty-five feet in height; and (2) The Subject Property shall be developed in accordance with the requirements set forth in Subpart III, Part 12 of the Zoning Code, in the event that the development of the Subject Property would be subject to the Subpart per Section 656.1209.

Amendment

Per OGC, the Amendment revises the legal description and approves the waiver, subject to the following conditions: (1) The address for the new residence shall be clearly identified as marked on a mailbox along Lenox Avenue; (2) There shall be a 35-foot-wide easement to Lenox Avenue, which contains a fifteen-foot-wide driveway access, which shall be stabilized with gravel or similar material to provide adequate access by emergency vehicles prior to the issuance of a permit for the new residence; and (3) There shall be no further subdivision of the entire property denoted as R.E. Number 008769-0000.

Amendment

Per OGC, the Amendment incorporates a revised PUD Written Description, dated August 15, 2011, and adds the following conditions: (1)         All sag lenses, drop lenses and convex lenses shall be prohibited.  Illumination levels at all property lines shall not exceed one-half (0.5) foot candles (f.c.) when the building or parking areas are located adjacent to residential areas, and shall not exceed one (1.0) f.c. when abutting other non-residential properties.  All lighting lamp sources within parking and pedestrian areas shall be metal halide or compact fluorescent.  The maximum light pole height in all parking areas shall not exceed twenty-five feet (25’-0”).  An exterior lighting design plan for each project, including a photometrics plan and pole and fixtures schedules shall be submitted at the time of Verification of Substantial Compliance for review and approval by the Planning and Development Department; (2) Trees planted in the southern uncomplementary land use buffer shall be a minimum two-inch caliper evergreen in a species which will reach a height at maturity of at least 20 feet; (3) Individual tenant changing message devices will not scroll and will not change more frequently than once every minute; (4) Any monument style signage shall be prohibited from using internal illumination; and (5) An uncomplementary land use buffer meeting the requirements of Section 656.1216, Zoning Code, and an eight-foot-tall fence shall be provided and maintained along the east side of the retention pond and the entire south property line.

Amendment

Per OGC, the Amendment incorporates a revised PUD Written Description, dated August 16, 2011, and a revised PUD Site Plan, dated August 3, 2011, and adds the following condition: (1) Prior to issuance of a Certificate of Use for, or commencement of, any outdoor storage or processing of scrap not contained within an enclosed structure, a landscape plan for property abutting City right-of-way for West Church Street shall be submitted for review and approval of the Planning and Development Department. All required landscaping material and visual screening of the West Church Street right-of-way shall meet the buffer material requirements of Section 656.1216 of the Zoning Code, within a ten (10) foot buffer strip, provided the buffer strip may include structures, access ways and signs, and a chain link fence with slats may be utilized. No visual screening is required for access way gates on West Church Street in front of employee/public parking. All landscaping and screening shall be installed prior to commencement of any outdoor storage or scrap processing use. Landscaping shall be installed and maintained between the fence and the right-of-way or street edge. Landscaping placed in the right-of-way shall be subject to review and approval of the Planning and Development Department.
