Amendment

Per OGC, the Amendment incorporates a revised PUD written description, dated June 7, 2011, and revised PUD site plan, dated May 12, 2011, and adds the following conditions: (1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated July 26, 2010, or as otherwise approved by the Planning and Development Department; and (2) All sag lenses, drop lenses and convex lenses shall be prohibited. Illumination levels at all property lines shall not exceed one half foot candles when the building or parking areas are located adjacent to residential areas, and shall not exceed one foot candle when abutting other non-residential properties. All lighting lamp sources within parking and pedestrian areas shall be metal halide or compact florescent.  The maximum light pole height in all parking areas should not exceed thirty feet. An exterior lighting design plan for each project, including a photometrics plan and pole and fixture schedules shall be submitted at the time of verification of substantial compliance for review and approval by the Planning and Development Department.

Revises recital; imposes an additional court cost of $50 (rather than the proposed $40) and revises its uses (provide free legal services for the disadvantaged through Jacksonville Area Legal Aid, Inc., including services to domestic violence victims, the mentally ill and/or disabled, the under- or unemployed, residents facing landlord/tenant issues or homelessness, foreclosure related educational, mediation and defense programs, and the elderly); provides for sunset on December 31, 2015 (rather than 2014).

Clarifies permission for the short selling of certain securities and investments by specifying the appropriate subsection of Florida Statutes (“215.47(15)” rather than “215.47”).

Claries various references to commercial fishing operations to address those licensed by the State of Florida; attaches an Exhibit 1, identifying those properties subject to the ordinance; provides criteria for new properties seeking the exemption (minimum of 1.5 acres in size; maintain 6-foot visual barrier, at least 95% opaque, to screen the portion of the property used for outside storage; storage of equipment must be clearly subordinate and incidental to the property’s use for residential purposes; and, all outside storage shall be of materials and equipment directly related to commercial fishing operations).

Includes an additional recital relative to diversity; requires that Ethics Commission members be registered voters of Duval County for 6 months prior to the introduction of their nomination for confirmation; omits requirement that attorney member have litigation experience; revises provision that no member be “an active state court judge” to state instead “an active judge;” requires that the Ethics Commission establish internal operating rules or bylaws; provides for appointment of Commission members (one each) by the Mayor, the President of the Council, the Sheriff, the Chief Judge for the Fourth Judicial Circuit, the State Attorney for the Fourth Judicial Circuit, and the Public Defender for the Fourth Judicial Circuit, with 3 Commission members to be appointed by the Commission; removes provision encouraging diversity in selections, instead making this a recital; removes language in various places specifically providing for coordination with the Ethics Office or Office of General Counsel; provides for “sworn” written complaints; provides for complaint initiation by vote of 6 members of the Commission; provides for “assistance and input” by the Commission relative to management and coordination of training and education; allows the Commission to act as the “recommendation” committee for the executive director of the Ethics Oversight and Compliance office (rather than acting as the hiring committee for the administrative staff of said office); requires that Commission meetings exempt from certain requirements of Florida States be recorded, with such recording becoming public upon conclusion of the investigatory matter; requires authorization by a circuit or county judge of the Fourth Judicial Circuit for issuance of a subpoena to compel the production of documents or testimony; permits enforcement by the Circuit Court relative to an order for a complaining party to pay costs and attorneys’ fees incurred by the Commission and/or an alleged violator; replaces appeal provisions with provisions allowing review of a final order of the Commission by the Circuit Court in such manner as is authorized for review of quasi judicial board decisions; makes other clarifying or technical changes and corrections.

Per OGC, the Amendment 1) denies the waiver; and 2) changes the request from a reduction of road frontage from 80 feet to 0 feet, to a reduction of road frontage from 35 feet to 0 feet.

Adopts the findings and conclusions of the Transportation, Energy and Utilities Committee; remands the appeal to the 911 Emergency Addressing Advisory Committee for further consideration.

(Finance) Generally incorporates provisions of the Rules Committee substitute; provides for appointment of an executive director for the Office of Ethics, Compliance and Oversight by the Ethics Commission, subject to Council confirmation.

 

 

 

 

 

(Rules) Revises and clarifies recitals; provides that the executive director of the Office of Ethics, Compliance and Oversight is to be recommended by the Ethics Commission and selected by the Mayor; the director is to be a registered Duval County voter at the time of hire, or relocate to Duval County within 6 months of hire; the director is to be appointed by the Mayor and confirmed by Council for a 3-year term following consideration of a list of 3 candidates recommended by the Ethics Commission; in the event of a director vacancy, the position is to be temporarily filled by a non-confirmed appointment by the Ethics Commission for a period not to exceed 180 days; minimal staffing requirements and the requirement that the ethics office be provided office space in City Hall are omitted; provides that supplemental support is to be provided at the request of the Ethics Commission, with administrative support to be provided by the Office of General Counsel and investigative support to be provided by the Council Auditor’s Office and Office of General Counsel; provides that special counsel may be retained in accordance with Ordinance Code provisions; clarifies that the obtaining of data and access to records is for that not otherwise deemed confidential by law regarding contracts or transactions with the City; exempts the City’s official ethics officer in 2010 from the director’s residency requirements should that person decide to pursue or accept such position; omits provisions for input and assistance from the Council Auditor relative to transition provisions; makes other clarifying and technical changes.
