Amendment

Per OGC, the Amendment incorporates a revised PUD Written Description, dated December 13, 2010, and a revised PUD site plan, dated October 8, 2010, and adds the following condition to the PUD: (1) The development shall proceed in accordance with the Development Services Division Memorandum dated December 8, 2010, or as otherwise approved by the Planning and Development Department.

(Rules) Eliminates proposed provisions concerning administrative approval of fair share assessment contracts using the alternative fair share formula; omits proposed provision allowing an eligible points matrix assessment reduction for jobs generated which would have allowed each construction job generated 0.1 points, up to a maximum of 2 points.

Amendment

Per OGC, the Amendment adds the following conditions to the PUD: (1) The required transportation improvements shall be made in accordance with the Development Services Division Memorandum dated November 10, 2010, or as otherwise approved by the Planning and Development Department; (2) Illumination levels at all property lines shall not exceed one foot candle when abutting non-residential properties. All lighting lamp sources within the parking and pedestrian areas shall be metal halide or compact florescent.  The maximum light pole height in all parking areas should not exceed fifteen feet. An exterior lighting design plan, including a photometrics plan, pole and fixtures schedules shall be submitted at the time of verification of substantial compliance for review and approval by the Planning and Development Department. This condition does not apply to any existing poles on the subject property; (3) The portion of the property facing St. Johns Bluff Road South shall be permitted either one sign that is 100 square feet in area on each side or two signs that are 50 square feet in area on each side.  The two signs must be separated by a minimum of 150 feet from each other.  The signs may be internally or externally illuminated monument style signs no greater than 15 feet in height. The portion of the property facing 9A shall be permitted one pylon sign with a 200 square foot area on each side, no more than 50 feet in height; (4) A landscape buffer meeting the requirements of Part 12 of the Zoning Code shall be installed and maintained along all portions of the subject property fronting St. Johns Bluff Road South; (5) All permitted uses or permissible uses by exception in the IBP Zoning District shall be considered through the Zoning Exception process; and (6) Reclaimed water shall be used as the primary water source for underground or other automatic irrigation systems.  Stormwater, surficial aquifer water or harvest rainwater may be used as the primary water source for irrigation only if reclaimed water is unavailable.  Floridan Aquifer and/or potable water may only be used for irrigation if reclaimed water, stormwater, surficial aquifer water, or harvest rainwater from cisterns or other collection devices becomes unavailable or demonstratively unsuitable.

Clarifies that the City Council shall review recommended priority populations by the Public Service Grant Council and establish priority populations to be served; clarifies example used to state “may” include (rather that “includes”) the cited example priority population; removes improvements to quality of life through cultural activities as a 2010-2011 priority population listed as being established under 2009-821-E; adds a recital stating the recommendations of the Public Service Grant Council are attached as Exhibit 1, and attaches said exhibit.

Authorizes the Mayor, or designee, and Corporation Secretary to execute necessary documents and take further action to effectuate the purpose of the ordinance; references and attaches a copy of the grant documents as Exhibit 1.

Clarifies location of artificial reef off the coast of Duval County at the permitted site known as Floyd’s Folly.

Strikes original appropriation information, and provides funding for furniture for the Dinsmore Museum, located at 7330 Civic Club Drive, in the amount of $27,543.07 ($16,306.00 from Dinsmore Park as appropriated in the legislation and $11,237.07 from Old Kings Road Landfill Class III Mitigation appropriated in previous ordinance), as described in the cost estimate in Exhibit 1; provides for a Revised Exhibit 2 to attach a contract which requires specific compliance with Jacksonville’s Procurement Code.

Per OGC, the Amendment attaches a revised Exhibit 1, a text amendment concerning family homesteads, to the Future Land Use Element of the 2030 Comprehensive Plan.

Reflects replacement of Alberta Hipps; clarifies responsibility of the Public Service Grant Council for making funding recommendations for (rather than distribution of) the public service grant appropriations of the City Council.
