Council
Member Anderson made a brief report on the MPS Parking Garages Subcommittee. The subcommittee has met twice and Mr.
Anderson thanked everyone involved for their good work to date. Legislation was filed for introduction this
morning that extend the term of the City’s option to purchase at the current
price for an additional 2 years to December 2013 and to amend the MPS agreement
to reduce the guaranteed return on investment from 8% to 6.75%. CFO Ronald Belton said that the parties agreed
to the extension so that MPS and the City can have the benefit of a year and a
half of new courthouse operations from May 2012 to December 2013 before the
City decides whether to exercise its option or not.
Council
Member Crescimbeni suggested the need, in an abundance of caution, to have a
garage purchase ordinance drafted and introduced to be on a parallel track with
the deadline extension legislation so that the City has a fall-back option
should MPS change its mind and decline to sign the extension before the end of
the year when the Council will have no further opportunity to act. In response to a question from Council Member
Schellenberg, Mr. Belton stated that MPS anticipates generating a positive cash
flow from the courthouse garage sometime after the garage opens next May. The financial picture will not be completely
positive beginning in the first month, but sometime in 2012 it will become apparent
what the financial expectations will be under normal circumstances.
Council
Member Anderson requested and Chairman Clark approved the continued operation
of the subcommittee while additional information is gathered and legislation is
filed and considered.
