Substitute

Designates the Finance Committee as the responsible committee for reporting on economic development incentive packages; revises / makes consistent Council Rule language regarding 1 & 2 read resolutions, and authority for economic incentive agreements to be approved by same; sets forth that Finance Committee shall meet on the 2nd and 4th Mondays of each month, during Council weeks, (in addition to the regularly scheduled 1st and 3rd week meetings) in order to review/report on 1 read resolutions (such meetings can be canceled if unneeded); establishes that all such resolutions shall be considered by Finance Committee after a public comment opportunity, and considered by Council after the regular public comment section of Council meetings, respectively; establishes the filing of legislation practice / deadline with Legislative Services Division (including required filing materials, online posting and notification to Council Members); modifies the Duval County Job Opportunity Bank provision to clarify that it is funded by City Council appropriation and that required funds from any agreements are appropriately monitored; city-level enterprise zone requirements are eliminated so that State-level enterprise zone requirements are what govern; keeps 2006 Incentive Policy intact except as modified in this ordinance and provides that in case of conflict with the current, existing policy, the provisions of 2012-213-E prevail.

Per OGC, the Amendment 1) changes the property owner to Salem Centre, LLC; 2) incorporates a revised PUD legal description; 3) incorporates a revised PUD written description, dated November 20, 2012; and 4) adds the following condition to the PUD: If a church is located within this PUD, the distance limitations set forth in Part 8 of the Jacksonville Zoning Code for on-premises consumption of alcohol, including beer, wine and/or liquor shall not apply when measuring the distance from any church located within this PUD to any hotel, motel or restaurant that does not qualify as a nightclub pursuant to Section 656.1601, Zoning Code, this includes, but is not limited to, the property with parcel identification/RE number 152594-8130.

Amendment

Per OGC, the Amendment adds the following conditions to the PUD: (1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated November 19, 2012, or as otherwise approved by the Planning and Development Department; (2) All sag lenses, drop lenses and convex lenses shall be prohibited. Illumination levels at all property lines shall not exceed one half foot candles when abutting other non-residential properties. All lighting lamp sources within parking and pedestrian areas shall be metal halide or compact florescent.  The maximum light pole height in all parking areas should not exceed thirty feet. An exterior lighting design plan, including a photometrics plan and pole and fixtures schedules shall be submitted at the time of verification of substantial compliance for review and approval by the Planning and Development Department; and (3) Pedestrian access shall be provided by sidewalks installed in accordance with the 2030 Comprehensive Plan, if required by law. Section VI.J. which says “[s]idewalks will not be constructed” is deleted from the written description.

Per OGC, the Amendment adds the following conditions to the PUD: (1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated November 1, 2012, or as otherwise approved by the Planning and Development Department; (2) If a church is located within this PUD, the distance limitations set forth in Part 8 of the Jacksonville Zoning Code for on-premises consumption of alcohol, including beer, wine and/or liquor shall not apply when measuring the distance from any church located within this PUD to any hotel or restaurant that does not qualify as a nightclub pursuant to Section 656.1601, Zoning Code; and (3) Future changes will be subject to further review and approval as permitted in the Zoning Code.

F: adds to the TEU amendment a requirement that the Economic Development Officer shall present any proposed downtown rate changes or discount programs to the DIA board for review and advisory recommendation; adds requirement that proposed rate changes and discount programs be provided to the Council Auditor and e-mailed to all City Council members upon filing; provides that rate changes shall become effective 30 days after filing.
