Substitute

Corrects name of agreement; attaches revised agreement; requires execution of FDOT/COJ agreement coterminous w/the FDOT approval of the coterminous plans for the park extension; adds provision regarding RAP responsibility for additional maintenance for 5 years – not to exceed $2500 annually; adds provision outlining RAP & COJ understanding; on page 2, line 8, insert “50/50 match for construction costs”; adds a June 30, 2015 deadline for RAP to raise the private funding for construction; construction may not commence until RAP has raised 90% of its half of the construction cost; during the years that RAP is responsible for maintenance of the park, RAP is obligated for up to $2500 per year in maintenance costs; if RAP’s $2500 does not cover all maintenance costs, the City may invoke a cancellation clause with 90 days’ notice to RAP; requires wording in the maintenance agreement such that RAP is not required to use the City’s park maintenance contractor to provide the dog park maintenance; adds RAP commitment letter to the bill.

Amendment

Per OGC, the Amendment incorporates a revised PUD written description, dated September 17, 2012 and a revised PUD site plan, dated August 10, 2012, and adds the following conditions to the PUD:  (1) The Subject Property shall be developed in accordance with the Development Services Division Memorandum dated August 21, 2012 or as otherwise approved by the Planning and Development Department; (2) A minimum twenty foot wide building setback shall be provided and maintained along the east property line.  A ten foot wide uncomplimentary buffer meeting Section 656.1216 of the Zoning Code shall be provided and maintained within said building setback; (3) The property owner shall record an Airport Notice Zone Acknowledgment in the public records of Duval County, Florida prior to the issuance of building permits.  A copy shall be provided to the Planning and Development Department at the time of verification of substantial compliance as required pursuant to Section 656.1010 of the Zoning Code; and  (4) At the time of verification of substantial compliance, architectural elevations shall be submitted to the Planning and Development Department for review and approval.  The elevations shall be a compatible architectural style as that set forth in the site plan.
