Amendment

Per OGC, the Amendment incorporates a revised PUD written description, dated March 5, 2012 and a revised PUD site plan, dated April 12, 2012; and adds the following conditions to the PUD: (1) The Subject Property shall be developed in accordance with the Development Services Division Memorandum dated December 27, 2011, or as otherwise approved by the Planning and Development Department; (2) The minimum yard setback requirement along the east property line shall be forty feet in width and along the north property line shall be fifteen feet in width; (3) No commercial vehicular delivery or access shall be allowed from Lane Avenue North; (4) A sidewalk along Trade Center Drive shall be installed prior to issuance of any Certificate of Use or commencement of use; (5) Signage on Lane Avenue and access to Lane Avenue will only be permitted for day care centers, care centers and group care homes, and no other uses, so long as such uses utilize structures on the Subject Property that are maintained with a residential character; and (6) The Subject property shall not be utilized for any addiction treatment programs, medical care or as a half-way house with residents mandated by the courts to attend.

Amendment

Per OGC, the Amendment 1) incorporates a revised legal description, 2) deletes the reference to RE number 152806-0000, 3) deletes the reference to  Calvin Waller as a property owner, 4) decreases the acreage from 4.9 acres to 3.48 acres, 5) incorporates a revised PUD written description, dated April 17, 2012 and a revised PUD site plan, dated April 12, 2012; and 6) adds the following conditions to the PUD: (1) The Subject Property shall be developed in accordance with the Development Services Division Memorandum dated March 2, 2012, or as otherwise approved by the Planning and Development Department; (2) No vehicles over 8 feet in height shall be parked or stored on the Subject Property within 125 feet of Lenoir Avenue; (3) All landscaping shall be installed and maintained as shown on the site plan dated April 12, 2012, or as otherwise approved by the Planning and Development Department; (4) A visual screen measured from the base of the existing grade to the finish floor of the building shall be installed and maintained along sides of the building except the northeast side of the building; (5) All the landscaping required interior of the fence shall be relocated outside of the fence, except for the landscaping located on the driveway access from Philips Highway as depicted on the site plan; and (6) No vehicles shall be parked outside of the fence, except for parking for customers and employees.

Amendment

Per OGC, the Amendment 1) reduces the property size to 17.33 acres; 2) adds Southeast Properties, Inc. as a property owner; 3) incorporates a revised legal description, and 4) adds the following conditions to the PUD: (1) The Subject Property shall be developed in accordance with the Development Services Division Memorandum dated March 7, 2012, or as otherwise approved by the Planning and Development Department; and (2) The applicant shall submit a detailed recreation amenity plan consistent with Section 656.1210(d) of the Zoning Code. The amenity plan shall be subject to the review and approval of the Planning and Development Department at the time of verification of Substantial Compliance. The approved recreation amenities in the plan shall be installed prior to issuing a Certificate of Occupancy for any residential use.

Amendment

Per OGC, the Amendment 1) adds the following RE numbers 089117-0000 and 089119-0000, and 2) changes the rezoning request from RMD-C to IL to a rezoning request from RMD-C to IBP.
