Amendment

Per OGC, the Amendment changes the acreage of the Subject Property from 1.51 acres to 1.84; and approves the administrative deviation request subject to the following conditions: (1) Development of the second, subordinate dwelling shall proceed in accordance with the site plan dated October 27, 2011; and (2) The Subject Property shall not be split or subdivided.

Amendment

Per OGC, the Amendment incorporates a revised PUD site plan, dated March 14, 2012, and a revised PUD written description, dated March 16, 2012, and adds the following conditions to the PUD:  (1) The Subject Property shall be developed in accordance with the Development Services Division Memorandum dated February 17, 2012, or as otherwise approved by the Planning and Development Department; (2) There shall be a 49 foot building setback along the north and east property lines for any structure over 20 feet in height; and (3) Only one monument sign, internally or externally illuminated, may be installed along Chaffee Road, and it shall not exceed 50 square feet in area and 15 feet in height.

Attaches revised 2nd amendment to fair share agreement to extend the completion deadline for 2 years, increase the developer’s credits, and allow the credits to be transferred by the developer throughout the applicable mobility zone instead of within a 2-mile radius.

Refers to “revised on file” lease which adds a condition stating that all animals will be removed from the facility at the termination of the lease; requires that any capital improvements to the building shall be free of any liens or encumbrances at time of termination; and limits the lease agreement to 12 months.
