AMENDMENTS and SUBSTITUTES

Amendment

Per OGC, the Amendment incorporates a revised PUD site plan dated February 2, 2012, and adds the following conditions to the PUD:  (1) The Subject Property shall be developed in accordance with the Development Services Division Memorandum dated September 26, 2011, or as otherwise approved by the Planning and Development Department; (2) The storage area(s) shall be completely enclosed on all sides by a fence, wall or landscaping screen that is six feet in height and 95 percent opaque; (3) There shall be no junkyards on the Subject Property as defined in Section 656.1601 (Definitions), Zoning Code.  There shall be no repair of any kind on any vehicles on the Subject Property; and (4) Outdoor storage of materials shall not exceed fifteen feet in height.

Amendment

Per OGC, the Amendment changes the names of the owners, incorporates a revised PUD written description, dated January 9, 2012, and adds the following conditions to the PUD:  (1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated January 17, 2012, or as otherwise approved by the Planning and Development Department; (2) Recreation space shall be provided and maintained on the subject property in accordance with Section 656.420(d), Zoning Code; (3) Pedestrian paths shall be provided and maintained on the subject property in accordance with and as described in the written description, dated January 9, 2012; (4) The developer shall submit architectural plans and elevations at the time of Verification of Substantial Compliance for review and approval by the Planning and Development Department; and (5) If reclaimed water is available, the use of the Floridan Aquifer shall be prohibited as a primary source for irrigation water.

Per OGC, the Amendment approves the waiver of road frontage request, subject to the following condition: (1) The home on the subject property shall be site built.

Corrects the body of the bill to reflect the appointment of Susan Lisa King, replacing W. Marc Hardesty.

Corrects a scrivener’s error in the title (“Statutes” rather than “Statute”); changes the heading for Section 1 from “Review of Lists and Credits” to “Non-Ad Valorem Recapitulation.”

Per OGC, the Amendment 1) adds a reference to community event parking in the bill title; 2) adds a reference in the bill to the supplements and amendment to the NOPC application; and 3) revises the NOPC application to include the supplements and amendment.

Corrects various errors involving spelling, bill section numbering, or Charter and Ordinance Code section titles; adds a new Ordinance Code section requiring that the Council Secretary/Director comply with certain post-redistricting requirements of Florida Statutes.
