Amendment

Per OGC, the Amendment adds the following conditions to the PUD: (1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated October 6, 2011, or as otherwise approved by the Planning and Development Department. With respect to comment number 3, access directly across from Grayfield Drive shall not be counted as right-in/right-out driveway. Additionally, the traffic signal shall not be required if it is determined not to be warranted based on the result of a traffic study undertaken by the applicant and approved by the Planning and Development Department, all of which shall take place prior to issuance of the first building permit for vertical construction on the Subject Property; (2) Prior to issuance of a certificate of occupancy for each outparcel, that portion of the internal access road or roads shown on the Site Plan that provide frontage for the outparcel shall be constructed.  For example, occupancy of the easternmost outparcel is conditioned upon the portion of the access road fronting the entire northern and eastern edges of the outparcel being completed.  Occupancy of the first outparcel located  adjacent to and fronting the right-in, right-out connection shown on the Site Plan shall also be conditioned upon construction of an internal access road connecting to the east-west internal access road shown on the Site Plan.  Upon completion of the entire internal vehicular access road connecting Collins Road on the easterly portion of the property and Plantation Bay Drive, as depicted on the Site Plan, such internal vehicular access road shall be opened and maintained for use as an approved private street or if accepted by the City, as an approved public street; and (3) All sag lenses, drop lenses and convex lenses shall be prohibited.  Illumination levels at all property lines shall not exceed one half foot candles when the building or parking areas are located adjacent to residential areas and shall not exceed one foot candle when abutting other non-residential properties.  All lighting lamp sources within the parking and pedestrian areas shall be metal halide or compact florescent.  The maximum light pole height in all parking areas should not exceed thirty feet.  An exterior lighting design plan for each project, including a photometrics plan, pole and fixture schedules shall be submitted at the time of verification of substantial compliance for review and approval by the Planning and Development Department.
