Amendment

(RCDPHS) Incorporates provisions of the Rules Committee amendment; requires that appropriated funds not be expended without written certification that all privately secured funding has first been applied towards the budget and been exhausted; requires that any funds not expended revert to the fund of origin.

 

 

 

 

Amendment

(Rules) Reduces the appropriated amount from $30,000 to $29,950; attaches the budget as Exhibit 1; specifies that funding be used exclusively for the parade and related expenses; appropriates funds to a Special Events account (rather than a Martin Luther King, Jr. Day Parade Account); provides for oversight by the Special Events function of the City (rather than the Recreation and Community Services Department).

Amendment

Per OGC, the Amendment 1) eliminates references to the companion small scale comprehensive plan amendment legislation; 2) changes the name of the PUD; 3) incorporates a revised PUD written description, dated January 13, 2012 and a revised PUD site plan, dated January 11, 2012; and 4) adds the following conditions to the PUD:  (a) The Subject Property shall be developed in accordance with the Development Services Division Memorandum dated November 3, 2011, or as otherwise approved by the Planning and Development Department; (b) The uses on the Subject Property shall be limited to i) those permitted uses in the CRO district, as set forth in the Zoning Code as of January 18, 2012, excluding adult congregate living facilities; ii) those additional uses specifically enumerated within Sections A(1) and A(2) of the written description, as qualified therein; iii) churches, including a rectory or similar use, as a permitted use, meeting the performance standards and development criteria set forth in Part 4 of the Zoning Code; and iv) daycares as a permissible use by exception, meeting the performance standards and development criteria set forth in Part 4 of the Zoning Code; (c) All sag lenses, drop lenses and convex lenses shall be prohibited. Illumination levels at all property lines shall not exceed one half foot candle when the building or parking areas are located adjacent to residential areas and shall not exceed one foot candle when abutting other non-residential properties. All lighting lamp sources within the parking and pedestrian areas shall be metal halide or compact florescent.  The maximum light pole height in all parking areas should not exceed thirty feet. An exterior lighting design plan for the development, including a photometrics plan, pole and fixture schedules shall be submitted at the time of verification of substantial compliance for review and approval by the Planning and Development Department; and (d) There will be a minimum 20 foot wide vegetative buffer along the southern property line of the Subject Property. This buffer can be reduced to 10 feet along the southwest property line of the Subject Property only in order to accommodate retention, as approved by the Planning and Development Department. The 10 foot reduction shall be limited to not more than 100 linear feet, measured from the southwest corner of the Subject Property.
