Deputy General Counsel Steve Rohan explained the major differences between the original bill and the substitute recommended yesterday by the Rules Committee: 1) the substitute deletes the transport permit requirement; 2) applies only to metal items; 3) deletes the time limit on issuance of checks for sale of materials; 4) the Sheriff will provide software needed for electronic reporting; 5) deletes references to attorney fees; 6) the ordinance will sunset in 3 years if not renewed by City Council.  Sheriff Rutherford stated that Orange County adopted an ordinance very similar to this one and saw a 24% decline in metal thefts.  Mac McCuller, representing Main Recycling, requested additional language changes to exempt certain transactions from the electronic reporting requirement.  He was requested to meet with Mr. Rohan and the Sheriff’s Office to craft language for consideration as a floor amendment at the Council meeting on Tuesday.

Joe whitaker of the JEDC responded to questions about how the JEDC verifies the contractual performance of incentive recipients.  Council Member Yarborough expressed concern with continuing to grant economic development incentives before all of the issues identified in the recent JEDC audit have been addressed by the administration and assurances given that the problems are under control.  JEDC Acting Executive Director Paul Crawford stated that the QTI incentive being proposed for this project is the most secure type of incentive because recipient performance is verified by the state and no payments are made until the company has created the promised jobs and paid its taxes.
