Planning Department staff explained the problem with the traffic signal not meeting the usual traffic manual standards for a signal location, but traffic in the area is problematic because of the amount of traffic and the practice of many motorists to either exit the parking lot by turning right and then making a U-turn at the next opportunity, or to cut through the adjacent shopping center parking lot to avoid the traffic backup at the exit.

The committee engaged in extensive questioning of and discussion with the applicant, appellant, and numerous speakers at the public hearing.  The committee discussed the merits of amending PUDs (by whatever method) over the course of time to adapt to changing market conditions versus maintaining the original intent of the PUD, which subsequent owners or adjacent property owners may have relied upon when making decisions of their own.  Potential problems with the Planning Commission original notification process (area residents not receiving notification letters about the public hearing) were discussed.

There shall be a minimum of 496 parking spaces for the residential units, with a minimum of one space per bedroom; 3. The property shall be developed in accordance with the site plan, dated September 14, 2012; 4. Prior to the Certificate of Occupancy for any residential units, the applicant shall install a 10 foot wide 95% opaque, six foot tall landscape buffer in the previous area between the drop off loading area and the northern façade of the Water’s Edge Development.
