Crescimbeni Report: Kelly Public hearing opened and closed The committee engaged in extensive questioning of and
discussion with the applicant, appellant, and numerous speakers at the public
hearing. The committee discussed the merits
of amending PUDs (by whatever method) over the course of time to adapt to
changing market conditions versus maintaining the original intent of the PUD,
which subsequent owners or adjacent property owners may have relied upon when
making decisions of their own.
Potential problems with the Planning Commission original notification
process (area residents not receiving notification
letters about the public hearing) were discussed. Motion/2nd to amend (Boyer/Redman) Motion/2nd to recommend approval as amended
(Schellenberg/Redman) AMEND/APPROVE
5-0 Amendment: Affirms the Planning Commission decision and modifies it to include
the following additional conditions: 1. Prior to issuance of a Certificate of
Occupancy for any residential units, the applicant shall construct and convey
fee title of the 86 parking spaces to
the Marina Association; 2. There shall be a minimum of 496 parking spaces for
the residential units, with a minimum of one space per bedroom; 3. The
property shall be developed in accordance with the site plan, dated September
14, 2012; 4. Prior to the Certificate of Occupancy for any residential units,
