Bill Summary

 

Dylan Reingold explained the process for consideration of this bill and related bill 2011-768, with attorneys for both parties agreeing to a format of opening statement, presentation and rebuttal, each side having 10 minutes to make its case for each bill.  Mr. Reingold gave an overview of how both this bill and 2011-768 have progressed through the administrative review and Planning Commission processes and arrived at the LUZ Committee on appeals.

 

Karl Sanders representing The Rock of Avondale (Kickbacks restaurant) and Jonathan Oliff representing Riverside/Avondale Preservation made presentations advocating their clients’ positions on the issue of RAP’s standing to appeal 2011-767 and answered numerous questions from the committee members on that subject.  In response to a question Mr. Reingold briefly recounted the sequence of events that led to there being two administrative deviation requests for differing numbers of parking spaces and the request to consolidate those two requests into one appeal.  The committee discussed the proper order for considering the two issues (standing and consolidation) and the proper time to hear from the public.  Mr. Oliff stated that the attorney for Kickbacks has proposed a settlement of the issues which will be presented to the RAP board of directors for their consideration next Monday or Tuesday evening.

 

The public hearing was opened; numerous speakers spoke for and against approval of the appeals.  The public hearing was continued to 3/6/12.
