Council President Bishop welcomed the new committee and thanked the members for their willingness to serve.  He urged the committee to make every effort to wrap up work on the pending economic development reform bills before August when the hard work on the budget begins, and asked the committee to please take action on 2012-296 (non-discrimination based on sexual orientation) in fairly short order, when ready, to clear it from the Council’s agenda.  Chairman Yarborough stated that he intended to try and take action on 2012-296 in the next committee cycle.

Council Member Crescimbeni recounted the history of term limitations on City Council members and on the constitutional officers in Jacksonville and opposed the bill because if offers the possibility, depending on the outcome of the proposed election, for some constitutional officers to serve as many as 4 or 5 consecutive terms if new limits begin with the next set of elections.  General Counsel Cindy Laquidara explained the recent Florida Supreme Court case from Broward County that restored the right of local governments to impose term limits and answered questions about why Clerk of the Courts Jim Fuller was allowed to be placed on the ballot for this fall’s elections after the court ruling was announced.  Ms. Laquidara stated that the role of the Supervisor of Elections with regard to candidates is primarily ministerial – if a candidate files the appropriate forms and attests that he/she meets the qualifications to run for the office, the Supervisor accepts that attestation and places the candidate on the ballot.  It is then a matter for a legal challenge to the candidate’s eligibility, which is usually filed by one of the other candidates for the office.  The Office of General Counsel could take action to clarify Mr. Fuller’s qualifications to run in the interest of protecting the City Charter, but that would have to be at the direction of a client, either the Mayor or City Council.  Council Member Crescimbeni announced his intention to draft a resolution directing the General Counsel to challenge Mr. Fuller’s qualification to run for another term.  Supervisor of Elections Jerry Holland stated that a citywide special election (i.e. to replace Mr. Fuller should he be re-elected and then removed by a subsequent legal challenge) would cost approximately $900,000 per election, or potentially $1.8 million total ([primary and general elections).

An amendment to remove the emergency language from the bill was approved.  The committee debated the purpose of the bill and questioned its actual impact, if passed, on courthouse project expenditures, given the Mayor’s ability to move funds from one project to another within the Unified Courthouse Project overall budget of $350 million.  General Counsel Cindy Laquidara and Assistant Council Auditor Janice Billy answered questions about the amount of funding remaining in the Unified Courthouse Project budget and the creation of a new project identifier.  President Bishop offered an amendment to reduce the appropriation from $30 million to $25,071,793.
