Chairwoman Boyer invited Planning and Development Director Calvin Burney to discuss the department’s interpretation of the 2030 Comprehensive Plan’s provisions regarding wetlands preservation and mitigation and how the LUZ Committee should be considering wetlands-related factors in the course of its work.  Mr. Burney said that the department relies primarily on the goals and policies in the Coastal and Conservation Element, including the overall goal of ensuring no net loss of existing wetlands function.  The department works in conjunction with the federal (Army Corps of Engineers) and state (Department of Environmental Protection, St. Johns River Water Management District) regulators and generally abides by their interpretations.  He explained that there are 3 categories of wetlands: salt water wetlands, riverine/estuarine wetlands and others. Mitigation credits don’t need to be in the same drainage basin as the wetlands being impacted, nor be in the Jacksonville city limits if the state agencies approve other locations.

 

In response to a question, Assistant General Counsel Jason Gabriel indicated that land use changes cannot be conditioned, including conditions regarding wetlands, but wetlands may be considered as one factor among others in determining whether to grant a requested change. Gary Kresel of the Planning Department stated that wetlands are evaluated based on their functionality, quality and condition, ability to mitigate and retain functionality on-site, and ability to mitigate off-site as a last resort.  In response to a question about whether there are Comp Plan policies that operate separately from state and federal regulatory policies, Mr. Kresel said that the City accepts whatever mitigation mechanisms are approved by those regulators; that is considered compliant with the Comp Plan.

 

Public Comment

Paul Harden urged the City not to add yet another layer of regulatory complexity and to accept the jurisdiction and regulations of the Army Corps of Engineers, Florida Department of Environmental Protection and St. Johns River Water Management District. He said that there are 3 drainage basins in Jacksonville and that if the City adopted a policy of requiring wetlands mitigation to take place within the same basin, there would be no more development in Basin 6 because there is no mitigation capacity to be had in that basin. Mr. Harden said the Army Corps of Engineers allows, and in fact encourage, use of mitigation bank credits in order to maintain the most functional large-scale wetlands rather than many small, isolated on-site wetlands. He stated that his clients’ two projects recommended for denial by the Planning Department today are the first two applications ever to be recommended for denial based on wetlands considerations since the adoption of the Comp Plan in 1990.

 

Karl Sanders expressed agreement with Mr. Harden’s comments and said the City has always accepted the DEP and SJRWMD jurisdiction and rules on wetlands.  The Comp Plan does not call for no net loss of wetlands, but for no net loss of wetland function, a crucial distinction.

 

Tom Ingram said that the Comp Plan is a high-level policy document, not a fine-grained regulatory document for every property in the city.  He advocated letting the Army Corps of Engineers, DEP and SJRWMD experts define and evaluate wetlands areas and deferring to their expertise. He stated that it is difficult to know definitively how wetlands will be impacted by a project until late in the development process when final site plans are developed, which is well past the land use and zoning change stages.
