 A lengthy discussion ensued before the Committee voted 6-1 (Daniels) to defer the measure.

 

Council Member Greg Anderson inquired why was it necessary for the Committee to act right away on this measure.  What was the sense of urgency.  Danny Hayes, an entertainment promoter, addressed the Committee and explained that there was an impending concert scheduled for Metropolitan Park (April 27-28) and that deferring this ordinance would put the concert promoters at risk because the industry standard concert’s transmitting decibel levels could potentially violate current noise level provisions of the Ordinance Code. 

 

Council Member Don Redman recommended that the bill be deferred until the Metropolitan Park Ad Hoc Committee had an opportunity to make recommendations.

 

Council Member Daniels (the measure’s sponsor) explained that the objective of the proposed ordinance was to fix an existing problem and that what she hoped to address and resolve with the proposed legislation was altogether different from the objectives of the Metropolitan Parks Ad Hoc Committee

 

Deputy General Counsel Peggy Sidman explained what the proposed bill entailed, particularly in expanding the Entertainment District.

 

Council Member Reggie Brown felt that the City should be dedicated to creating a friendly environment to lure the entertainment industry; attracting the entertainment industry meant local jobs.

 

Council Member Lori Boyer explained the provisions in the Ordinance Code that related to sound level standards.  She underscored the difference between the point at which sound is created and the point where the sound is heard.  Council Member Warren Jones concurred with the observation about where the sound is received, noting that noise violations are complaint driven.

 

Council Member Matt Schellenberg asked Ginny Myrick, a St. Nicholas resident, to provide the Committee with her views on the issue under discussion.  Ms. Myrick explained that her neighborhood welcomed and had  no problem with City-sponsored events.  The 12-ticketed events of the entertainment promoters were much louder.  She contended that the type of music was not the issue; the issue was the high volume of the music.

 

Council Member John Crescimbeni questioned the promoters present about other venues where they have staged events.  He inquired about the nature of contracts that they have had.  Mr. Crescimbeni contended that the Entertainment Zone should be abolished, that it was created solely for the (2005) Super Bowl.

He was not supportive of the bill.

 

Council Member Boyer indicated that she was inclined to defer the bill and letting the Ad Hoc Committee that was meeting on Thursday come up with a proposed solution for the next Council meeting’s consideration.

 

Council Member Anderson indicated that he favored deferral.
